Order

17/08/2026

1. Petitioner has filed instant writ petition under Article 227 of the Constitution of India seeking direction against the trial Court to abide by the mandatory timeline, fixed by the High Court in the order dated 11.11.2024, passed in S. B. Civil Petition No.15770/2020.

2. The grievance of petitioner is that the preliminary decree for partition was passed on the terms and conditions, mutually agreed between the parties but since respondent did not abide by the conditions, hence, petitioner filed application under Order 20 Rule 18 read with Section 151 CPC, which has not been decided by the trial Court on merits, till date.

[2026:RJ-JP:32562] (2 of 2) [CW-12451/2026]

3. This Court finds that in the order dated 11.11.2024, directions to decide the application under Order 20 Rule 18 read with Section 151 CPC have already been issued, hence, no further directions are required and counsel for the petitioner does not want to press this writ petition.

4. Accordingly, this writ petition is dismissed as not pressed.

5. Stay application and all pending application(s), if any, also stand disposed of. (SUDESH BANSAL),J 4/POORAN CHAND GUPTA
