1. By way of this criminal misc. petition under Section 528 of BNSS, the petitioner-complainant has approached this Court with a prayer to quash the FIR No.43/2017 registered at Police Station Kotkhawda, District Jaipur City (South) for offences punishable under Sections 420, 467, 468, 471, 472, 384 and 120B of IPC against the accused-persons, on the basis of compromise.
(2 of 3) [CRLMP-3545/2026]
2. Surprisingly, this petition has been filed by the complainant himself to quash the impugned FIR lodged by him.
3. Learned counsel for the petitioner submits that except the petitioner, interest of no other person is not involved in the present dispute. Counsel submits that in first round of investigation, negative final report was submitted observing that the dispute is with regards to civil nature. Thereafter, the petitioner-complainant filed a protest petition against the Final report and the learned Court allowed the same and directed further investigation in the present matter.
4. Counsel submits that now, parties have resolved their dispute and in these circumstances, petitioner/complainant do not want to pursue this FIR. Counsel submits that on account of compromise, further proceedings in the impugned FIR are fruitless and continuation thereof would be a futile exercise and a waste of precious judicial time and resources. The copy of written compromise has been annexed with this petition.
5. Learned Public Prosecutor places on record the factual report dated 14.08.2026 received from SHO, Police Station Kotkhawda, District Jaipur City (South). According to which, parties have resolved their dispute amicably.
6. Learned counsel appearing for accused-respondents No.2 to 4 does not dispute the factum of compromise.
7. In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for perusal; considering the fact that parties have resolved their dispute amicably and also finding that the present
(3 of 3) [CRLMP-3545/2026] case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh vs. State of Punjab & Anr. reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. vs. Choudhary Bhajan Lal & Ors. reported in AIR 1992 SC 604 and as such, the impugned FIR is liable to be quashed in view of compromise arrived at between the parties.
8. In view of the above, this Criminal Misc. Petition is allowed and the FIR No.43/2017 registered at Police Station Kotkhawda, District Jaipur City (South) along with all consequential criminal proceedings arising out of it are quashed and set aside. Consequence to follow.
9. Stay application and pending application(s), if any, also stand disposed of. (ANIL KUMAR UPMAN),J 55/MADAN
