1. The present bail applications have been filed under Section 483 of BNSS, 2023 against the orders dated 13.07.2026 & 03.08.2026 passed by the learned Sessions Judge, District- Bharatpur, in Bail Application Nos. 356/2026 & 394/2026

(2 of 4) [CRLMB-11332/2026] respectively, whereby the bail applications of the petitioner were rejected in connection with F.I.R. Nos.172/2026 & 173/2026, Police Station-Mathura Gate, District-Bharatpur for the offences under Sections 318(4), 319(2) & 61(2) of BNS, 2023.

2. Learned counsel for the petitioner submits that the allegation against the petitioner is that he is the owner of an Institute, namely, ‘Maa Chamunda Institute’ where he provides coaching classes. He further submits that it is alleged that he had arranged for other students to appear in the examination in place of the actual candidates for obtaining the benefits under the scheme provided to the students, and thereby cheated the authorities. He further submits that neither did he arrange for anyone to appear in the examination nor was he involved in doing so and such allegation is incorrect. He is merely the person running the coaching institute where the six students studied, and those students have been found to have not appeared in the examination themselves, as someone else appeared in the examination on their behalf.

3. Learned counsel for the petitioner submits that there are no criminal antecedents against the petitioner except the present two FIRs i.e., 172/2026 & 173/2026 which were filed in respect to the said six children.

4. Learned counsel for the petitioner submits that the conclusion of investigation/trial will take sufficiently long time and all the offences are triable by Magistrate, therefore, he prays that the petitioner may be enlarged on bail as the accused-petitioner was initially taken into custody in FIR No. 172/2026 on

(3 of 4) [CRLMB-11332/2026] 08.07.2026 and thereafter was taken into custody on 29.07.2026 in FIR No.173/2026.

5. Learned Public Prosecutor vehemently opposes the present bail applications.

6. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.

7. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, particularly the fact that the only allegation levelled against the present petitioner is that he was merely the owner of the institute; the examination was not conducted at the petitioner’s institute but at some other place over which the petitioner had no control; there are no criminal antecedents against the petitioner except the present two FIRs, i.e. 172/2026 and 173/2026, which relate to six children; all the offences are triable by a Magistrate, coupled with the fact that the conclusion of the investigation/trial is likely to take a sufficiently long time, this Court is of the considered opinion that the bail applications deserve to be accepted

8. Consequently, the bail applications are allowed. It is ordered that the accused-petitioner namely - Dasso Alias Shivsevak S/o Nawab Singh arrested in connection with F.I.R. Nos.172/2026 & 173/2026, Police Station-Mathura Gate, District- Bharatpur, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/- (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court, with the stipulation that he shall appear before the said Court on all dates of hearing and as

(4 of 4) [CRLMB-11332/2026] and when called upon to do so until completion of the trial, subject to the following conditions:

(i) The petitioner shall not leave country without the permission of the Court;

(ii) The petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected;

(iii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. (BIPIN GUPTA),J 60 and 85/MAHIMA
