Order

13/08/2026

1. Instant Civil writ petition under Article 227 of the Constitution of India has been filed by petitioners praying to set aside/modify the order dated 13.03.2026 whereby and whereunder complaint filed by petitioner bearing No. 134/2024 was dismissed as withdrawn so also impugning the order dated 02.04.2026 whereby and whereunder misc. application filed by petitioners seeking to recall/modify the order dated 13.03.2026 has been dismissed by Permanent Lok Adalat, Jaipur Metro-I, Jaipur.

2. Notices were issued but no one has appeared on behalf of the respondent.

(2 of 3) [CW-8226/2026]

3. The precise grievance of petitioners is that the subject matter of complaint filed before the Permanent Lok Adalat was exceeding the pecuniary jurisdiction of Permanent Lok Adalat, hence, in order to avail the remedy for redressal of their grievance before the appropriate forum of law, complaint was withdrawn by the petitioners but the Permanent Lok Adalat simply permitted withdrawal of complaint vide order dated 13.03.2026 without recording the reasons of withdrawal and liberty to petitioners to avail the remedy before any other appropriate forum of law. Thereafter, it appears that petitioners filed an application before the Permanent Lok Adalat seeking to recall or modify the order dated 13.03.2026 but that application has been dismissed vide order dated 02.04.2026, hence assailing both the orders, petitioners have filed this writ petition for seeking liberty to avail remedy before the appropriate forum of law. Petitioners also pray to grant exemption of limitation under Section 14 of Limitation Act about period during which their complaint before the Permanent Lok Adalat remained pending in good faith.

4. Considering the grievances of petitioners, this Court finds that on account of the orders dated 13.03.2026 and 02.04.2026, petitioners are not precluded from taking their legal remedies before any appropriate forum of law and if petitioners want to seek exemption of the period of limitation for the period during which the proceedings before the Permanent Lok Adalat remained pending in good faith, it is open for the petitioners to move appropriate application under Section 14 of Limitation Act before the forum, wheresoever petitioners want to take their legal remedy, which may be considered on its own merits.

(3 of 3) [CW-8226/2026]

5. With the aforesaid observations, without interference with the impugned orders, the writ petition stands disposed of.

6. Stay application and all pending applications, if any, also stand disposed of. (SUDESH BANSAL),J 37/pcg/rachna
