(2 of 3) [CRLMB-4456/2026]
1. The present bail applications have been filed under Section 483 BNSS, 2023 against the order dated 06.03.2026 and 24.02.2026 respectively, passed by learned Additional Sessions Judge No. 1, District-Kota, in Criminal Misc. Bail Application (CIS) Nos. 547/2026 and 496/2026, whereby the bail applications of the petitioners were rejected in connection with F.I.R. No.154/2025, Police Station-GRP Kota, District Kota, for the offences under Section 318(4), 316(2), 338, 61(2) of the BNS, 2023.
2. Learned counsel for the petitioners that there are no criminal antecedents against the petitioners of having committed any offences of similar or any other nature in the past.
3. Learned counsel for the petitioners submits that the challan has already been filed, trial will take sufficiently long time and even the offences are triable by Magistrate, and therefore, he prays that the petitioners be enlarged on bail as the accused- petitioner Kaushal Sharma and Anupam Chaudhary are in custody since 12.02.2026 and 11.02.2026, respectively.
4. Learned Public Prosecutor vehemently opposes the bail application.
5. Heard learned counsel for the petitioners and learned Public Prosecutor and perused the material available on record.
6. Without expressing any opinion on the merits and demerits of the case and upon consideration of the arguments advanced that allegation against the petitioners is that they had cheated the complainant with around Rs. 2,00,000/- for getting her compassionate appointment in the Railway Department; there are no criminal antecedents against the petitioners of having committed any offences of similar or any other nature in the past;
(3 of 3) [CRLMB-4456/2026] trial will take considerable long time and even the offences are triable by Magistrate, therefore, this Court is of the opinion that the bail application filed by the petitioners deserves to be accepted.
7. Consequently, the bail applications are allowed. It is ordered that the accused-petitioners - Kaushal Sharma S/o Dhanraj Shringi and (ii) Anupam Choudhary S/o Mohan Choudhary arrested in connection with F.I.R.
