1. The present bail applications have been filed under Section 483 BNSS, 2023 against the orders dated 11.05.2026 and

(2 of 3) [CRLMB-7776/2026] 13.05.2026 respectively passed by learned Additional Sessions Judge, Karauli Rajasthan, in Criminal Misc. Case No (CIS).217/2026, and 222/2026 respectively, whereby the bail applications of the petitioner were rejected in connection with two F.I.R.s bearing Nos.163/2022 and 84/2024 registered at Police Station Kudgaon, District Karauli for the offences under Sections 420, 409, 467, 468, 471, 120 B, 201, 166 of the IPC, 1860.

2. Learned counsel for the petitioners submits that the petitioner is in custody since 02.05.2026 and 05.05.2026, respectively in the matters. He submits that the challan in the case has already been filed and there are no criminal antecedents against the petitioners except the present two F.I.R.s. Learned counsel for the petitioner further submits that the amount involved in dispute has already been deposited by the petitioner and the same has been refunded back to the Gram Panchayat. Moreover, the conclusion of trial will take sufficiently long time and even the offences are triable by a Magistrate, therefore, he prays that the petitioner may be enlarged on bail as the accused is in custody since 02.05.2026.

3. Learned Public Prosecutor vehemently opposes the bail application.

4. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.

5. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact that challan has been filed; all the offences are triable by Magistrate; the conclusion of trial is likely to take a considerable time; further the fact that the amount alleged to be

(3 of 3) [CRLMB-7776/2026] misappropriated has already been deposited by the petitioner with the Gram Panchayat; there are no criminal antecedents except the present two F.I.R.s against the accused-petitioner, this Court is of the opinion that the bail application deserves to be accepted.

6. Consequently, the bail applications are allowed. It is ordered that the accused-petitioner - (i)Roshan Singh S/o Shri Fatehsingh arrested in connection with two F.I.R.s bearing Nos. 163/2022 and 84/2024 registered at Police Station Kudgaon, District Karauli, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so till the completion of the trial and with additional following conditions:

(i) The petitioner shall not leave country without the permission of the Court;

(ii) The petitioner shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected; and

(iii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. (BIPIN GUPTA),J 113-114/KRATIKA
