Order
05/08/2026
1. This contempt petition has been filed by the petitioner alleging non-compliance of order dated 22.01.2025.
2. By the order dated 22.01.2025, the Court set aside the order dated 30.07.2009 and remitted back the matter to the Collector, Ajmer to decide the revision in accordance with law after providing an opportunity of hearing to the affected parties.
3. Learned counsel for the petitioner submits that even after the specific directions of this Court made vide order dated
(2 of 3) [CCP-517/2026] 22.01.2025 and serving a legal notice dated 29.08.2025, the District Collector has not decided the revision petition and no opportunity of hearing has been afforded to the petitioner as ordered by this Court.
4. Considered the submissions made by learned counsel for the petitioner.
5. The petitioner has filed this contempt petition alleging non- compliance of the order dated 22.01.2025, whereby the Court directed the District Collector, Ajmer to decide the revision preferred by the petitioner afresh in accordance with law after providing an opportunity of hearing to the affected parties. The petitioner has placed before this Court the letter dated 06.05.2025 (Annexure-2), which is an information given under the Right to Information Act, whereby it has been intimated that the records up to the year 2016 have been destroyed by the Panchayat Branch.
6. As per the provisions of law, a revision petition field by any person is to be considered and decided by the Revisional Authority on the basis of record of the Court/Authority, who has passed the order under scrutiny before the Revisional Authority.
7. Since the record pertaining to the issue pending before the District Collector was already destroyed and unless the petitioner is able to submit any copy of that record, it would not be possible for the District Collector to decide the revision petition for want of necessary record. Deciding a revision petition without going through the pertaining records would also be illegal.
8. In view of the above, the Court finds that there is no deliberate disobedience on the part of the District Collector, Ajmer
(3 of 3) [CCP-517/2026] as regards the order dated 22.01.2025, passed in S.B. Civil Writ Petition No. 8529/2010.
9. Accordingly, this contempt petition is dismissed. (GANESH RAM MEENA),J Gaurav Srivastava/12
