Order

04/08/2026 This writ petition has been filed the petitioner with the following prayers:- “It is, therefore, most respectfully prayed that Your Lordships may graciously be pleased accept and allow this writ petition, call for entire record pertaining to the present matter and by an appropriate writ, order or direction

i) Hon'ble Court may kindly be pleased to direct the respondent authorities to remove the encroachment on Khasra No. 206 admeasuring 57 bigha 8 biswa recorded in Jamabandi in the name of Village Nayagaon Gram Panchayat Sargaon and further that the said land be used for development of gram panchayat; ii) Quash and set aside any regularization in favour of private respondents that may be done by the authorities during pendency of this PIL:

iii) any other relief which the Hon'ble Court may deem fit and proper may kindly be passed in favour of the petitioner.” Counsel for the respondents submits that with regard to same land in dispute, a civil suit is pending before the Civil Court of Judicial Magistrate at Kishangarh, District Ajmer. In this regard, certified copy of the order sheets have been placed on record. Heard counsel for the parties and perused the record. Admittedly, the civil suit with regard to same land in dispute is pending before the Civil Court.

(3 of 3) [CW-16852/2024] In that view of the matter, this writ petition stands disposed of with liberty to the petitioner for impleadment of the necessary party in the pending civil suit before the Civil Court. (SANDEEP TANEJA),J (INDERJEET SINGH),J 111/JYOTI
