Order
03/08/2026 These appeals have been preferred by the appellants challenging the order dated 30.07.2024 passed by the learned Single Judge. Learned counsel for the appellants submits that the learned Single Judge erred in not awarding the interest on due amount in favour of the appellants. Learned counsel for the respondents opposed the appeals. We have gone through the order dated 30.07.2024 passed by the learned Single Judge, wherein, para No.8 reads as under:- “8.Perusal of the record indicates that several applications of similar nature under Section 33(C)(2) of the Act of 1947 were submitted by several workmen. Some of the applications filed by the said workmen were allowed by the Labour Court, but in those matters, no such direction was issued by the Labour Court against the petitioner-company to make the payment of due amount with interest. This fact has been established on the record that the petitioner-company is facing and suffering financial crises and crunch, that is why, delay has occurred in making payment of due amount to the respective workmen. Considering this material aspect of the matter and looking to the fact that in some of the matters the Labour Court has not granted any interest to the workmen and in the fitness of
(3 of 3) [SAW-775/2024] the case and looking to facts & circumstances of the case and in the interest of both petitioner-company as well as the respondents-workmen, this Court deems it just and proper to dispose of all these petitions with directions to the petitioner- company to make payment of due amount within a period of eight weeks from today.” We are in complete agreement with the view taken by the learned Single Judge. The learned Single Judge taken into consideration the financial condition of the respondent-company and, in the peculiar facts and circumstances of the case, directed payment of the admitted dues without interest. Learned counsel for the respondents further informed the Court that the entire due amount has already been paid to the appellants. In that view of the matter, we find no merit in these appeals. Therefore, appeals are accordingly, dismissed. All pending application(s), if any, shall also stand dismissed. (SANDEEP TANEJA),J (INDERJEET SINGH),J 91-93/Upendra Pratap Singh
