Order

29/07/2026

1. The present appeal has been filed against the order dated 07.05.2004 passed by the Additional District Judge No.1, Jaipur City, Jaipur in Civil Suit No.1/2003, whereby the learned Trial Court determined the provisional rent under the Rajasthan Premises (Control of Rent and Eviction) Act, 1950.

2. The defendant-appellant has also filed a cross-objection in the present appeal challenging the said order.

3. After arguing for some time, learned counsel for the parties jointly submit that they do not want to press the present appeal and the cross-objection, and pray that, as the civil suit is still pending, a direction be given to the learned Trial Court to dispose of the aforesaid civil suit expeditiously.

4. Prayer, as sought for, is allowed.

5. Accordingly, the present appeal and the cross-objection are dismissed as not pressed.

6. Considering the submissions of learned counsel and the fact that the civil suit is pending since 2003, the learned Trial Court is expected to conclude the trial as expeditiously as possible, preferably within a period of three months from today.

7. All pending application(s), if any, stand disposed of.

8. Registry is directed to send the record of the case to the learned Trial Court forthwith. (SANDEEP TANEJA),J 11-12/AVINASH GULERIA
