1. Heard.
2. Issue notice to the respondents.
3. Mr. Udit Sharma, learned counsel accepts notice on behalf of the respondents.

Learned counsel for the appellant submits that the order of transfer was originally passed transferring the respondent-writ petitioner from Kotputli to Neemrana but later on another order was passed on the same day mentioning that the officers who are under transfer like the petitioner would be transferred to new place of posting namely Neemrana to Kherli.

Learned counsel for the respondents submits that in the meanwhile, the respondent-writ petitioner had already joined at Neemrana and till that time the new order dated 10.07.2026 was passed wherein, he was shown to be under transfer from Neemrana and was actually transferred to Kherli, had not been dispatched. He received the order after joining later on at Neemrana and the order is actually back dated.

We find that on the said contentions, the learned Single Judge has stayed the effect and operation of the subsequent transfer order dated 10.07.2026 qua the petitioner which is under challenge before us. Ordinarily, we do not interfere with the interim orders passed by the Single Bench, unless we find that the same are of final nature.

In the present case, staying the operation of the subsequent transfer order would result in respondent continuing at Neemrana which stands already modified on the same day merely because the respondent had joined, would not give him any benefit. Therefore, effect and operation of the order passed by the learned

The post held by the respondent is a senior gazetted post of Assistant Engineer (O&M) and he would, therefore, be expected to join at places where he is asked to perform duties, more so the places which are nearby to one another from his last posting namely Kotputli.
