5. The Police after completion of the investigation, has submitted charge-sheet in the matter. The petitioner is said to have been in custody since 31.01.2026. As per the facts, the prosecution story is that there was recovery of 54.490 Kg Dodha-Chura from the house of co-accused namely Ratan.

6. As per the learned Public Prosecutor, the allegation and evidence against the present accused-petitioner are that the co-accused, from whose house the alleged Dodha-Chura was recovered, was using a mobile phone with the SIM card registered in the name of the present accused-petitioner.

7. As per the submissions made by the learned Public Prosecutor, there is no other evidence connecting the accused- petitioner with the alleged offence except the fact that the co-accused, Ratan, was using a SIM card registered in the name of the present accused-petitioner. Merely because another person was using a mobile phone or a SIM card registered in the name of some other person, cannot be said a connection of the person with the alleged offence committed by the other person.

8. Looking to the facts and the evidence collected, this Court is prima facie satisfied as required under Section 37 of the NDPS Act. Accordingly, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.
