24/07/2026 This writ petition has been filed by the petitioner only with a limited prayer that the first preference given by the petitioner in the online application form is Barmer for appointment to the post of Village Development Officer, however, she wants to relinquish her first preference and prays for appointment in view of her merit to the remaining preferences given by her.

(2 of 3) [CW-11792/2026] Learned counsel submits that the petitioner while submitting online application form inadvertently made District Barmer as a first preference for appointment on the post of Village Development Officer, however, the only prayer of the petitioner is that she wants to relinquish her first preference and may take into consideration the remaining preferences in its descending order. Learned counsel also submits that the petitioner may be allowed to relinquish her first preference of Barmer and giving appointment on the basis of other preferences as per her merit would not in any manner adversely affect any of the candidate. Learned counsel for the respondent-State submits that any change in the preference would be contrary to the terms and conditions of the advertisement. Learned counsel appearing for the Selection Board submits that they have already forwarded the select list and it is the State who has made allotment. Considered the submissions made by the learned counsel for the petitioner as well as the counsel for the respondents and perused the material made available on record. The only prayer of the petitioner is that the first preference which she has given while submitting the online application form, she wants to relinquish that first preference and has prayed for appointment on the post of Village Development Officer on the basis of other preferences as per her merit given by her. Though, the terms and conditions of the advertisement does not provide for correction in the preferences given in the online application form but looking to the fact that the petitioner is a single woman and is not claiming any right so as to merit over any

(3 of 3) [CW-11792/2026] meritorious candidates, the Court feels and that ends of justice would meet if the petitioner is permitted to relinquish her first preference of Barmer and she may be allowed appointment on the post of Village Development Officer as per her merit in accordance with other preferences given by her in the online application form. Accordingly, the present writ petition is disposed of as under:- The respondents are directed to allow the petitioner to relinquish her first preference of Barmer for appointment to the post of Village Development Officer. They are further directed to give appointment to the petitioner on the post of Village Development Officer in view of her merit and in accordance with other preferences given by her in the online application form except Barmer. Stay application as well as pending application(s), if any, also stands disposed of. (GANESH RAM MEENA),J YOGESH KUMAR/16
