1. The present writ petition has been filed by the petitioner with a challenge to the order dated 22.09.2025 whereby, the petitioner who is working on the post of Principal at Govt. Senior Secondary School, Sola, District Sikar has been transferred to Govt. Senior Secondary School, Kotda R Jalore. He has also challenged the order dated 01.04.2026 whereby, the representation submitted by

(2 of 3) [CW-6450/2026] the petitioner as regards his grievances towards his impugned transfer order has been rejected.

2. Heard.

3. Considered the submissions made by counsel for the parties.

4. The petitioner is working on the post of Principal at Government Senior Secondary School and he is a Government servant as defined Sub-section (c) of Section 2 of the Rajasthan Civil Services (Service Matters Appellate Tribunals) Act, 1976 (hereinafter to be referred as “the Act of 1976”),

5. The petitioner by way of the present writ petition has challenged the order of transfer and so also rejection of representation earlier to the transfer. The subject transfer has been included in the definition of ‘service matter’ as given in Sub-section (f) of Section 2 of the Act of 1976.

6. Section 4 of the Act of 1976 provides for remedy of appeal before the Rajasthan Civil Services Appellate Tribunal against the order passed by any officer or authority on any service matter or matters affecting a Government servant in his personal capacity.

7. In view of the provisions, the petitioner is having an alternative remedy of appeal before the Rajasthan Civil Services Appellate Tribunal so as to order of his transfer and so also against rejection of his representation. Since the petitioner is having statutory alternative remedy of appeal, this Court is not inclined to exercise power conferred under Article 226 of the Constitution of India directly without availing remedy of appeal.

8. Accordingly, the present writ petition is dismissed.

(3 of 3) [CW-6450/2026]

9. However, the petitioner would be at liberty to avail remedy of appeal before the Rajasthan Civil Services Appellate Tribunal.

10. Stay application as well as pending application, if any, also stands disposed of. (GANESH RAM MEENA),J 10/Ashish Kumar
