Order

30/06/2026

1. Both the second bail applications have been filed by the accused-petitioners under Section 483 B.N.S.S., arising out of F.I.R. No.520/2023 registered with the Police Station Kotkasim, District Khairthal-Tijara for offence under Sections 458, 459 and

(2 of 3) [CRLMB-8507/2026] 380 of I.P.C.

2. Heard.

3. Considered the submissions made at bar and also perused the challan papers as well as the statements of the prosecution witnesses, examined so far.

4. As per the contents of the F.I.R., both the accused- petitioners have not been named in the F.I.R. The material injured witness, Suman, has been examined as PW-4 and during her examination, she has categorically stated that except one accused, Rahul @ PK, she does not know any other accused persons and during investigation, the accused were not got identified by the Police. The accused-petitioners are said to have been in custody for last two years and till date, eleven prosecution witnesses out of seventeen, have been examined.

5. Considering the fact that there is delay in the examination of the prosecution witnesses, which is not attributed to the accused- petitioners; co-accused namely; Rahul @ PK, who has been named in the F.I.R., Manish and Ashish, have already been enlarged on bail by this Court; and so also to maintain the parity, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused- petitioners on bail.

6. Accordingly, both the second bail applications are allowed and it is directed that accused-petitioners shall be released on bail provided each of them furnishes a personal bond in the sum of

(3 of 3) [CRLMB-8507/2026] Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that they shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.

7. Registry is directed to place a copy of this order in connected bail application. (GANESH RAM MEENA),J 7/ARTI SHARMA
