Order

19/06/2026

1. The instant bail application has been filed by the petitioner Bhagchand S/o Shri Babulal under Section 483 B.N.S.S., 2023, who was arrested by the police in connection with FIR bearing No.173/2025 dated 16.09.2025 registered at Police Station Phulera, District Jaipur Rural for the offences punishable under Sections 318(4), 316(2), 61(2) B.N.S., 2023.

2. Learned counsel submits that the allegations levelled against the petitioner in the FIR are in respect of a fraud committed with different persons, which amounts to Rs.1,14,20,287/-. Learned counsel submits that the petitioner merely gave access of his account to be used as a mule account through which the Cyber crime was committed, for which he took some money in relation

(2 of 3) [CRLMB-13253/2025] to the transactions and has not played any specific role in the complete act. Learned counsel further submits that the Police, after investigation has filed the charge-sheet. In view thereof, learned counsel prays that the accused-petitioner be enlarged on bail.

3. Learned Public Prosecutor along-with present Investigating Officer, who are present in the Court and the previous Investigating Officer, who is present in the Court through Video Conferencing, failed to satisfy this Court regarding the investigation conducted in respect of an amount of Rs.1,14,20,287/- as reported in the FIR, which pertains to various cyber frauds. The previous Investigating Officer, Mr. Anupam Mishra, Dy. S.P. appearing through VC, on being asked as to where the money has gone, has failed to investigate the complete trail of money even after a gap of more than ten months. The Investigating Officer submits that the person who gave his account to be used as a mule account was arrested and rest of the persons, who were involved in this commission of crime are out of their reach.

4. This Court finds that the Investigating Officer has not investigated the matter properly involving such a huge amount. Considering the investigation as done till now by the Police Officers and in the manner the charge-sheet has been filed by them, this Court is not satisfied with the same.

5. Considering the overall facts and circumstances of the case as well as nature of allegation, this Court is not inclined to enlarge the present petitioner on bail.

(3 of 3) [CRLMB-13253/2025]

6. Accordingly, the instant criminal misc. bail application is dismissed.

7. A copy of this order be sent to the Director General of Cyber Crime, Rajasthan to take necessary actions. (RAVI CHIRANIA (V.J.)),J 311/Monika
