These instant bail applications have been filed by the petitioners Asri Alias Attri W/o Sahab Khan, Shabnam W/o Islam, Ayesha W/o Zakir, Farzana W/o Assu @ Aslam and Asgari W/o Samsu, who were arrested by the police in connection with the FIR No.26/2010 dated 19.02.2010 registered at Police Station Jurhara, District Bharatpur for the offences punishable under Sections 147, 148, 149, 323, 332, 353 and 307 of the IPC, 1860, Section 3 of the PDPP Act, 1984 and Section 3/25 of the Arms Act, 1959.

2. Learned counsel submits that petitioners herein are all females of different age, who surrendered before the learned Trial Court on 19.05.2026. He further submits that petitioners have been falsely implicated in the case and have not committed any offence as alleged in the FIR. He further submits that the main accused, against whom allegation of causing firearm injury was levelled, has already been convicted by the learned Trial Court vide judgment dated 05.12.2011. In view thereof, learned counsel prays that the petitioners, being females, may be enlarged on bail in the given facts and circumstances of the case.

3. Learned Public Prosecutor strongly opposes the bail application.

4. This Court considered the fact that though the main accused has already been convicted by the learned Trial Court and the trial has concluded, the matter is more than 16 years old and there is no possibility that the petitioners will affect the trial. Without

(3 of 3) [CRLMB-8592/2026] making any comments on the merits and demerits of the case, this Court is inclined to enlarge the petitioners on bail.

5. Accordingly, the instant bail applications filed under Section 483 BNSS is allowed and it is directed that petitioners Asri Alias Attri W/o Sahab Khan, Shabnam W/o Islam, Ayesha W/o Zakir, Farzana W/o Assu @ Aslam and Asgari W/o Samsu shall be released on bail, provided each of them executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned Trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.

6. The petitioners are further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observations as made by this Court in the bail application will not affect trial of the case. The petitioner shall mark his presence before the concerned SHO of the Police Station twice a month for the entire period of the trial. The SHO shall maintain register to mark presence of the petitioners. In case the petitioners fail to appear twice in any month then the same shall be considered as breach and the bail shall stands cancelled without further reference to this Court.

7. It is further directed that in case, the petitioners are found to be involved in any case of Arms Act during pendency of the trial, learned Public Prosecutor shall file an application for cancellation of the bail. (RAVI CHIRANIA (V.J.)),J 324-326/RAHUL KUMAR
