Ld. Counsel of the applicant argued that on account of his illness on 11.01.2019 he couldn’t appeared before this Tribunal but the applicant was appearing in some other court in Ahmadabad, therefore, he couldn’t attend this Tribunal. I have perused the order dt. 11.01.2019 passed in M.A. no. 29/15 and found that the bank has already been issued sale certificate on 17.02.2015 and original title deed were also taken by them on 17.07.2017 in the proceedings of O.A. no. 14/13 and therefore, nothing was found in adjudication. The M.A. applicant is habitual defaulter and therefore, the grounds taken in this M.A. are not genuine reasonable and cannot accepted. Accordingly, the M.A. is dismissed with no cost.
