This matter is posted today as Mr. Karma Thinlay Namgyal, learned Senior Counsel, appointed as an Arbitrator in this matter, recused himself by stating that he had advised the petitioner in this matter. Apparently, the matter is posted today. Learned Counsel for both the parties agreed for appointment of Mr. Asutosh Moulik, learned Senior Counsel, as the Sole Arbitrator subject to Mr. Asutosh Moulik declaring within seven (07) days, from the date of receipt of copy of this order that none of the declarations referred to in the seventh schedule apply or disable him from being appointed as an Arbitrator in this matter. The fees of the Arbitrator shall be in accordance with the fourth schedule of the Arbitration and Conciliation Act, 1996. Ordered accordingly.
