VRKR,J I.A.No.2 of 2025 In Cross Objections No.83 of 2025 In M.A.C.M.A. No.3505 of 2011
This application is filed to condone the delay of 5096 days in filing the Cross Objections in M.A.C.M.A. No.3505 of 2011.
Heard learned counsel for the petitioners.
Learned counsel for the petitioners relied upon the decision of the Hon’ble Supreme Court in Surekha Vs. Santosh1, wherein it was held that, in matters relating to compensation claims arising out of motor vehicle accidents, the Court should not adopt a hypertechnical approach but should ensure that just and fair compensation is awarded to the victims or their claimants. Even though, the delay is enormous, as held in the above said decision, the claimants are entitled for just and fair compensation without preferring any cross objection or cross-appeal.
