ORDER

1. This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioners-A2 and A3 on bail in connection with FIR.No.1500 of 2026 of Gachibowli Police Station, Cyberabad Commissionerate. The offences alleged against the petitioners-A2 and A3 are punishable under Sections 127(2), 109(1), 308(2), 61(2) r/w 3(5) of BNS.

2. Heard Sri Ponnam Ashok Goud, learned counsel for the petitioners and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

3. Learned counsel for the petitioners submits that the petitioners-A2 and A3 are innocent and they have not committed any offence as alleged by the prosecution. The allegations against the petitioners-A2 and A3 are required to be tested during the trial and not at the stage of bail. Prosecution has relied upon the fact that A1, A4 and A7 are allegedly absconding and the alleged conduct of other accused persons cannot automatically be attributed to the petitioners- A2 and A3. Petitioners-A2 and A3 are separate individuals and the Court is not required to conduct a meticulous appreciation of evidence or determine the ultimate guilt of the petitioners-A2 and A3. Petitioners-A2 and A3 are arrested and remanded to judicial custody on 26.08.2026, since then they are in jail, entire investigation is completed and prayed to enlarge the petitioners-A2 and A3 on bail.

4. Learned Additional Public Prosecutor submits that the role played by the petitioners-A2 and A3 is shown in the remand case diary apart from that petitioner No.1-A2 is involved in five crimes and petitioner No.2-A3 is involved in four crimes, they are not entitled for grant of bail.

5. R. Rambabu has lodged the complaint before P.S. Gachibowli on 24.08.2026. It is stated in the complaint that on 22.08.2026 at 03:00 PM, he went to his in laws house along with his relatives by name Bellam Raviteja, Suryavardhan and Akhilesh to bring his wife back, he was taken upstairs on the pretext of collecting his luggage and was locked inside the room, while his relatives were subsequently sent away, thereafter, his wife Madhavi along with mother-in- law Neelam Sunitha, brothers-in-law Neelam Ravi and Neelam Kiran and her sisters Shobha, Pushpa, Saraswathi and others allegedly assaulted him with hands, legs, footwear, sticks, an iron baseball bat and other objects which caused head injury. Basing on the said complaint, FIR came to be registered.

6. Petitioners-A2 and A3 were arrested and remanded to judicial custody on 26.08.2026, since then they are in jail.

7. Remand case diary goes to show that A1, A4 to A7 are absconding. Respondent has altogether examined 10 witnesses.

8. Petitioner No.1-A2 is involved in five crimes and petitioner No.2-A3 is involved in four crimes.

9. Learned Additional Public Prosecutor has filed a chart showing the stage of the cases. Petitioner No.1-A2 is convicted in Crime No.439 of 2024 under the gaming act and two other crimes are pending for trial (Crime No.657 of 2023 and Crime No.1421 of 2024)

10. Petitioner No.2-A3 is also convicted in Crime No.440 of 2024 of gaming act and he is facing trial in Crime No.657 of 2023; Crime No.1353 of 2023; Crime No.354 of 2024 and in crime No.1421 of 2024.

11. The remand report goes to show that major portion of the investigation is completed, detaining the petitioners-A2 and A3 further in judicial custody will not serve the purpose. Hence, petitioners-A2 and A3 are entitled to be enlarged on bail, subject to the following conditions:

i. The petitioners-A2 and A3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned X Additional Judicial Magistrate of First Class, at Kukatpally. ii. The petitioners-A2 and A3 shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioners-A2 and A3 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS). iv. The petitioners-A2 and A3 shall not involve in similar offence. v. It is made clear that if any of the conditions imposed by this Court are violated, the prosecution is at liberty to file an application for cancellation of the bail.

12. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. __________________________ B.R.MADHUSUDHAN RAO, J Date: 14.10.2026 TU
