Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or Writ or direction more particularly in the nature of Writ of Mandamus by declaring the in action of Respondents in not passing orders on Petitioners application dt.01-10-2026 and threatening to demolish the Petitioners construction over Plot No.4, Sy.No.569,572 and 573 at Kapra Village, Kapra Circle - 1, Uppal Zone, Malkajgiri Municipal Corporation is as illegal, false and against the Principal of natural justice and subsequently direct the Respondents to consider and pass orders on the Petitioners application dt.01-10- 2026, Uls. 455 A, 455AA of GHMC Act for regularization of the unauthorized additional residential construction on the subject property.

Heard Mr. Ogirala Siddhardha, learned counsel for the petitioners; and Mr. G. Madhusudhan Reddy, learned Standing Counsel for Malkajgiri Municipal Corporation (lVlVC), appearing for respondent Nos.2 and 3; and perused the material available on record.

Learned Standing Counsel for MMC appearing for respondent Nos.2 and 3 submitted that the petitioners' representation dated 01 .10.2026, seeking regularisation of the pent house situated on the second floor of the subject building constructed on Plot No.4 in Survey Nos.569, 572 and 573 al Kapra Village, Kapra Circle-|, Uppal Zone, Malkajgiri Municipality Corporation, would be considered in accordance

with law. Learned Standing Counsel submitted that reasonable costs may be imposed. as was done in similar circumstances by order dated 17 062026 in W P No.18424ot2026.

3. ln view of the above, the writ petition is disposed of, directing respondent No.2 - Commissioner, MMC, HMDA Complex, Tarnaka, Hyderabad, to consider the regularisation application dated 01 .10.2026

submitted by the'petitioners, seeking regularisation of the pent house situated on the second floor of the subject building constructed on Plot No.4 in Survey Nos 569, 572 and 573 of Kapra Village, Kapra Crrcle - 1, Uppal Zone, Malkajgiri Municipal Corporation, and pass orders in accordance with law, by issuing notice to the petitioners and all other concerned/interested persons, by affording an opportunity of hearing to them, subject to the condition of the petitioners paying costs of Rs 1,00,000/- (Rupees One Lakh only) to the Malkajgiri Municipal Corporation. The Commissioner, Ii/alkajgiri Municipal Corporation, shall utilize the said amount for providing health benefits to the Class-lV

employees like scavengers, sanitary workers, sweepers etc. who are appointed on contractuai or outsourcing basis.

4 Untir disposar of the petitioners' regurarisation application dated 01 10.2026. status quo obtaining as on today shall be maintained in respect of the sub1ect property. There shall be no order as to costs.
