ORDER:
Heard learned counsel for the petitioners and Mr. Putta Krishna Reddy, learned standlng counsel for respondent No.3 - Mancherial Municipal Corporation.
2. Learned counsel for the petitioners submitted that the impugned notice dated 08.10.2026 is arbitrary and is issued without following the provisions of the Telangana Municipalities Act. 2019. The structures raised by the petitioners are stable and not in a dilapidated condition. The impugned notice has been issued on being influenced by local authorities and persons, who are inimical to the petitioners. A news item was published in Andhra Prabha newspaper falsely alleging that the building of the petitioners is in a dilapidated condition. In fact, the building is occupied by tenants and there is a Dental clinic.
EI
3, Learned standing counsel for respondent No.3 submitted that action will be taken against the petitloners in pursuance of the impugned notice by obtaining technical report from competent authority. The petitioners will be given reasonable opportunity of hearing before any action is taken for removal of structures. The building of the petitioners was found to be in a dilapidated and dangerous condition, as per inspection report of the Town Planning officials.
4. In view of the above, considering that the petitioners were not issued prior notice before any action was initiated and as it is apprehended that the structures will be demolished pursuant to the impugned notice dated 08.10.2026, the writ petition is disposed of permitting the petitioners to submit explanation to the impugned notice dated 08.10.2026 within a period of ten (10) days from the date of receipt of a copy of this order. The respondent No.3 is directed to consider such explanation, by giving opportunity of hearing to the petitioners and by requisitioning structural stability report from the competent a uthority/agency as the case may be and pass orders, in accordance with law, within a period of three
(3) weeks thereafter. The petitioners are directed to take necessary precautions to shift the tenants occupying the building so as to avo,d any unnecessary risk.
J The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs. Sd/-B.REKHA RANI ASSISTANT REGTSTRAR //TRUE COPY// /,- oYo To SA SECTI FFICER
