ORDER

This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioners, who are arrayed as accused Nos.2 and 4, on bail in connection with FIR No.960 of 2026 of Keesara Police Station, Malkajgiri District, registered for the offences punishable under Sections 110, 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023 (for short, ‘BNS’).

2. Heard Mr.Jella Naresh Kumar, learned counsel for the petitioners and Mr.D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

3. The brief facts of the case are that in view of the previous grudges between the accused and the complainant, on 27.09.2026 at about 18:30 hours, while the complainant along with his cousin brothers namely Abhishek, Sankeerth and Vivek were proceeded on their motor cycles to have Tea and when they reached Bandlaguda Kaman, Vipul and Praveen, followed them and assaulted them by kicking them with bricks and stones and also abused the complainant and his family members in filthy language. It is stated that the complainant and others sustained bleeding injuries. Basing on the said facts, the present crime is registered against the petitioners and others.

4. Learned counsel for the petitioners submits that the offences alleged against the petitioners are punishable with less than 7 years of imprisonment. He further contends that as a counter blast to F.I.R.No.960 of 2026 another F.I.R.No.959 of 2026 is registered by JCL-1/complainant for the offences punishable under Sections 118(1), 351(2), 352 of BNS. Therefore, he contends that, as a counter blast to the present Crime No.960 of 2026 another F.I.R.No.959 of 2026 is registered by the same complainant on 27.09.2026, Therefore, he seeks to enlarge the petitioners on bail.

5. Learned Additional Public Prosecutor opposes the bail application.

6. Having regard to the facts and circumstances of the case and upon considering the fact that the petitioners are in jail from 30.09.2026 and most of the investigation is completed, detaining the petitioners-accused Nos.2 and 4 further in judicial custody will not serve any purpose. Hence, this Court is of the view that the petitioners – accused Nos.2 and 4 are entitled for grant of bail, subject to the following conditions: i. The petitioners – accused Nos.2 and 4 shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned III Additional Junior Civil Judge-cum-III Additional Judicial Magistrate of First Class, at Kushaiguda. ii. The petitioners – accused Nos.2 and 4 shall appear before the concerned SHO

between 11:00 a.m. and 5:00 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required. iii. The petitioners – accused Nos.2 and 4 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS). iv. The petitioners - accused Nos.2 and 4 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses. v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

7. Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
