Shanker Singh, H.No. 14-10-865, Lower Dhoolpet, Hyderabad ...RESPONDENTS Petition under Anicle 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the Official Respondent Nos.1 to 7 more particularly the Respondent No.2 to 7 in spite of receiving Petitioners Written complaint dt.24.08.2026 in not taking necessary action against the Unofficial Respondent Nos.08 who have carried out illegal and unauthorized construction on the public road, and also on the footpath, while encroaching electric pole and also made construction on GHMC drainage line and constructed Permanent Wall/ Structure also carried entire construction on the Road without valid permission from the GHMC Authority and the Respondent No.08 has erected Big Size Gate while raised permanent Wall/Structure on the Public Road while grabbing the entire footpath and Road Margrn and he has also encroached electric pole which is in front of his house and it is effecting his ingress and aggress to his property and also illegal construction on the entire Road Margin and encroachment entire footpath in front his House Property bearing Municipal No. 14-10-865, Lower Dhoolpet, Hyderabad, without any proper valid permission from the GHMC Authority fo- carrying out their illegal c,:nstruction, as arbitrary, discriminatory, ex- facie illegal, highhanded, and giving colorable exercise to its statutory powers which is in violat on of principles of natural justice and consequently may direct the Official Respondent Nos.l to 7 more particularly the Respondent No.2 to 7 to take necessary action on the Petitioner said Written Complaint dt.24.08.2026by removing the said entire illegal construction from the Road Margin and also the encroachment from the footpath in front of his house in House Property bearing [V'lunicipal No. 14-1 0-865, Lower Dhoolpet, Hyderabad, without any permission or without any valid permission from the GHMC Authority for carrying out the illegal construction, carried out by the Unofficial Respondent No.08, in the interest of .justice. l.A. Learned Standing Counsel appearing for GHIVIC submitted that the petitioner's complaint daled 24.08.2026, alleging unauthorised construction and encroachment upon the footpath by respondent No. B in front of the petitioner's house property bearing Municipal No.14-1 0-865, Lower Dhoolpet, Hyderabad, would be duly considered in accordance with law. ---""

In view of the above, the writ petition is disposed of, directing respondent No.5 - Deputy Commissioner, GHMC, Circle No.30, Goshamahal, Abids, Hyderabad, to act upon the petitioner's complaint dated 24.08.2026, alleging unauthorised construction and encroachment upon the footpath by respondent No. 8 in front of the petitioner's house property bearing Municipal No.14-10-865, Lower Dhoolpet, Hyderabad, within a period of four (04) weeks from the date of receipt of a copy of this order, by issuing notice to the petitioner and respcndent No.B and by affording an.opportunity of hearing to them. As this rrrder is passed without entering into the merits of the case, notice to respondent No.B is dispensed with. However, if respondent No.8 is in any way aggrieved by this order, he is at liberty to approach this Court seeking modification of this order. There shall be no order as to costsi.
