MANDAMUS declaring the action of the official Respondent Nos. 1 to 3 in not implementing the speaking order dated 27th May 2026 in Lr. No.

MMC/G1/GHAT 1051264212026 and in not removing the unauthorised blue tin-sheet shed and other illegal constructions raised by the Respondent Nos. 4 and 5 on Survey No. 110/C of Rampally Village, Keesara Mandal, Medchal-Malkajgiri District, at the Main Road of Rampally, as illegal, arbitrary, contrary to the municipal laws and building regulations and violative of Articles 14,21 and 300-4 of the Constitution of lndia and consequently direct the Respondent Nos. 'l to 3 to immediately implement the said speaking order, to cause removal of the unauthorised shed and all connected illegal constructions, to restrain the Respondent Nos. 4 and 5 from raising any further construction on the said land.

Heard Mr. N. Lakshmi Narayana, leamed counsel for the petitioners and Mr. Srinivas Rao Pachwa, leamed standing counsel for Malkajgiri Municipal Corporation (MMC) appearing for respondent Nos.2 and 3.

Leamed standing counsel for MMC submitted that speaking order dated 27.05.2026 will be implemented and unauthorized shed made by respondent Nos.4 and 5 in Sy.No.l10/C situated at Main Road, Rampally Village, Circ,le-06, Ghatkesar, lJppal Zote, -

Malkajgiri Municipal Corporation, will be removed, if so far not removed.

Recording the aforesaid submission of leamed standing counsel for MMC, without going into the merits of the case, the writ petition is disposed of, directing respondent No.3 to forthwith implement the speaking order vide Lr.No.MMC/GllGHATlO5l 264212026 dated 27.05.2026, by affording opportuniry of hearing to all parties, as expeditiously as possible, preferably within a period ofthree (3) weeks from the date ofreceipt ofa copy ofthis order.

As this order is passed without entering into the merits, notice to respondent Nos.4 and 5 is dispensed with. If respondent Nos.4 and 5 are in any way aggrieved by this order, they are at liberty to approach this Court seeking modification of this order.

No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
