ORDER
1. This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused No.9 in connection with FIR No.242 of 2024 of INSP ADMIN (DD) Police Station, Hyderabad District. The offences alleged against the petitioner-A9 are punishable under Sections 316(2), 318(4) r/w 61(2) of BNS, Section 5 of TSPDEF Act and Section 12 of Chit Fund Act.
2. Heard Sri Mohammad Naseer Pasha, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.
3. Learned counsel for the petitioner submits that petitioner-A9 is falsely implicated in the crime, the complaint is vague and does not attribute any specific overt act individually nor does it disclose the necessary ingredients to constitute the alleged offences. Investigation in the present case has been substantially completed and all material evidence has been collected. There is no possibility of the petitioner-A9 tampering with evidence or influencing the witnesses. Petitioner-A9 was arrested on 14.08.2026 and he is in remand since 15.08.2026. A1, A2, A4 and A8 are enlarged on bail by the learned District Court and prayed to enlarge the petitioner-A9 on bail.
4. Respondent has filed counter and contended that investigation revealed that the petitioner-A9 has actively assisted A1 in introducing investors and mobilizing funds from them. It appears that approximately 190 investors were introduced through A9 through whom an amount of about Rs.16 Crores was mobilized. For facilitating the mobilization of the said funds, A9 received a commission of about 2% to 3%, amounting to approximately Rs.75 to 80 Lakhs. The receipt of the commission establishes his financial benefit and active participation in the transactions, there is possibility of the petitioner-A9 influencing or contacting the investors which may prejudice the investigation and prayed to dismiss the petition.
5. S. Nalini Reddy has lodged a report before P.S. INSP ADMIN (DD) on 04.12.2024. It is stated in the complaint that Pradeep Shiv Kumar Patil, Balaji Peedapatel and Chandrakanth Patel established several companies and Balaji Peddapatel is responsible for managing the DEMAT accounts and overseeing the so-called "KingpinAccounts," which were controlled by his brother, sister-Warle Ashathai, mother Usha Bhai who are involved in the operation and she had invested an amount of Rs.15,50,000/-, she came to know that 250 investors are defrauded, and lost their investment amount of Rs.44 crores. Basing on the said complaint, FIR came to be registered under different sections of BNSS and TSPDEF Act and TSCFA against the Pradeep Shiv Kumar Patil, Balaji Peedapatel, Usha Bhai, Warle Ashathai, Shubangi
Patil, Shivkant Anandrao Mungade and Chandrakanth Patel.
6. Petitioner-A9 was arrested on 14.08.2026 and he was produced before the concerned Magistrate for remand on 15.08.2026, since then he is in jail.
7. Remand Case Diary goes to show that respondent has examined altogether 07 witnesses in support of the prosecution case.
8. A1-Pradeep Shiv Kumar Patil is enlarged on bail by the learned Sessions Court on 31.08.2026 vide Crl.M.P.No.4039 of 2026. A2-Balaji Pedda Patil and A4- Warle Asha Thai were also enlarged by the learned Sessions Court on 12.05.2026 vide Crl.M.P.No.2168 of 2026. A8-Pitla Balraju is enlarged on bail vide Crl.M.P.No.4374 of 2026 dated 28.09.2026.
9. Since prime accused i.e. A1 and A2 are already enlarged on bail by the learned Sessions Court, it appears from the record that major portion of the investigation is completed, detaining the petitioner-A9 further in judicial custody will not serve the purpose.
Hence, petitioner-A9 is entitled to be enlarged on bail, subject to the following conditions: i. The petitioner-A9 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XII Additional Chief Judicial Magistrate, Hyderabad, at Nampally. ii. The petitioner-A9 shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner-A9 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS). iv. The petitioner-A9 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses and shall not contact the victim.
v. It is made clear that if any of the conditions imposed by this Court are violated, the prosecution is at liberty to file an application for cancellation of the bail.
10. Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed. __________________________ B.R.MADHUSUDHAN RAO, J Date: 05.10.2026 TU
