ORDER

1. This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused connection with FIR No.506 of 2026 of Jagtial Town Police Station, Jagtial District. The offences alleged against the petitioner- accused are punishable under Sections 69, 88 and 351(2) of BNS.

2. Heard Sri D. Bhaskar Reddy, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

3. Learned counsel for the petitioner submits that petitioner-accused is innocent of the alleged offences and he is falsely implicated in the case. On reading of the complaint itself discloses that the de-facto complainant and the petitioner-accused came in contact with each other about 10 years back and thereafter when the petitioner-accused made her a phone call she blocked his number and thereafter they were not in contact with each other. Petitioner-accused is a married person and the de- facto complainant is also a married woman therefore the allegations of the complainant that the petitioner-accused assured her to marry and had sexual relationship is improbable to believe when both of them are already married and their 1st marriage is subsisting. Section 69 of BNS is not attracted. Petitioner-accused is arrested and remanded to judicial custody on 13.09.2026, most of the investigation is completed and prayed to enlarge the petitioner-accused on bail.

4. Notice got issued to de-facto complainant is served, proof is filed to that effect.

5. Learned Additional Public Prosecutor submits that Section 183 of BNSS statement of the victim was scheduled on Saturday (03.10.2026), the same could not be recorded on the above said date and a fresh date has to be fixed by the trial Court.

6. De-facto complainant has lodged a report before P.S. Jagtial Town on 13.09.2026. It is stated in the complaint that accused has became acquainted with her during her Court visits at Jagtial and developed intimacy with her, frequently spoke to her over phone call, induced and falsely assured her that he will help her in her father's POCSO case and will marry her. On 09.04.2024, accused took her to a penthouse at Opposite Karimnagar Milk diary, Jagtial town and had physical relationship with her, which continued for some time. Accused has taken approximately Rs.5,00,000/- from the complainant on several occasions. Basing on the said complaint, FIR came to be registered.

7. Petitioner-accused was arrested on 13.09.2026, since then he is in jail. It is mentioned in the remand case diary that the petitioner-accused had sexual intercourse with the complainant on number of occasions. On the first occasion, when she became pregnant, she has taken tablets and her pregnancy was terminated. On the second occasion, she became pregnant in the month of January 2026 and she was taken to Shivansh Hospital and informed them that the complainant do not want a child. The doctor told her that her husband had to come and sign on the papers for abortion. It is further mentioned in the remand case diary that the complainant’s husband is an alcoholic and does not do any work, she already had one daughter and that is enough and her husband went to Bombay three days ago.

8. Complaint and the remand case diary goes to show that the de-facto complainant is already married and her marriage is subsisting with her husband. Petitioner- accused is also married, the question of promising the complainant to marry her is beyond truth. This Court is conscious of the fact that Section 183 BNSS statement of the victim is not yet recorded as on date.

9. Remand Case Diary goes to show that respondent has examined altogether 11 witnesses in support of the prosecution case. Hence, petitioner-accused is entitled to be enlarged on bail, subject to the following conditions:

i. The petitioner-accused shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial First Class Magistrate, at Jagtial. ii. The petitioner-accused shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner-accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS). iv. The petitioner-accused shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses. v. It is made clear that if any of the conditions imposed by this Court are violated, the prosecution is at liberty to file an application for cancellation of the bail.

10. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. __________________________ B.R.MADHUSUDHAN RAO, J Date: 05.10.2026 TU
