4. The petitioner is the atrsolute owner ancl possessor of the land admeasuring Ac.4.20 gts. in Sy No 62/Ot1t2 situated at Balanpur Village, Bazarhathnoor IVlandal, Aditabad District (hereinafter referred to as the, subject property,) and has been in contrnuous possessron and enjoyment thereof. Based on the application submitted by respondent No 5 alleging that respondent No.7, who is a non_tribal, had illegally mutated/partitioned the subject property in favour of the petitioner herein, who rs also a non{ribal, in violation of the provisions of the Telangana Scheduled Area Land Transfer Regulation. 1970 (for short the 'LTR Regulations,), respondent No.3 conducted an enqurry into the matter. Upon finding that the petitioner had contravened Section 3(j) of the LTR Regulations, respondent No 3 ordered ejectment of the petitioner from the subject prope(y and directed that the same be taken into Government custody. Aggrieved thereby, the petitioner filed the present writ petition, apprehending her dispossession from the subject property,
5. Learned counsel for the petitioner submits that the transaction is between the non-tribals. With properly appreciating the material on record and based on mere assumptions and presumptions, respondent No.3 passed the inipugned order directing the ejectment of the petitioner from the subject property, thereby causing grave prejudice to her.
6. Learned Government pleader for Social Welfare appearing for respondent Nos.1 to 4, on instructions, submits that aggrieved by the order, dated 30.05.2026, the petitioner, instead of availing the statutory remedy of appeal before the competent authority, has directly approached this Court by filing the present writ petition.
7. At this juncture, learned counsel for the petitioner fairly admits that the petitioner has not preferred any appeal against the order, dated 30.05.2026 passed by respondent No.3. However, he seeks liberty of this court to prefer an appear and submits that till the filing of the appeal, both parties may be directed to maintain status quo with regard to the subject property.
Learned Government pleader for Social Welfare reported no objection
9. ln view of the above submissions, vrithout expressing any opinion on the merits and demerits of the case, this Court, deems it appropriate to dispose of the writ petition, directing both parties to maintain status quo, with regard to the subject property, for a period of two (2) months from today. rn the meanwhire, the petrtioner shall file an appeal agatnst the order, dated 30.05,2026 passed by respondent No.3.
