ORDER
1. This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused No.6 in connection with FIR No.326 of 2026 of Karimnagar Rural Police Station, Karimnagar District, the offences alleged against the petitioner-accused No.6 are under Section 8(c) read with 20(b)(ii)(A)(B), 27(a) and 29 of the NDPS Act, 1985 and Sections 271, 272, 223, 125 read with 3(5) of the BNS, 2023.
2. Heard Sri M. Phanindra Bhargav, learned counsel for the petitioner-accused No.6 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.
3. Learned counsel for the petitioner submits that a bear perusal of the remand report clearly demonstrates that absolutely no contraband, narcotic drug or psychotropic substance was recovered from the physical or conscious possession of the petitioner-accused No.6. The prosecution alleges that 500 grams of hash oil was recovered from accused No.1 and 500 grams of ganja from accused No.2, the only item allegedly seized from the possession of the petitioner-accused No.6 is his personal mobile phone (Redmi 9 Power). Petitioner-accused No.6 is falsely implicated in the case. Even accepting the prosecution’s false narrative at face value, the alleged recovery of 500 grams of hash oil and 500 grams of ganja falls squarely within the intermediate quantity. Petitioner-accused No.6 is arrested in Crime No.326 of 2026 on 28.08.2026 and was produced before concerned Magistrate for remand. Police has completed the investigation and filing of charge sheet is leftover, prayed to enlarge the petitioner-accused No.6 on bail.
4. Learned Additional Public Prosecutor submits that the role played by the petitioner-accused No.6 is clearly depicted in the remand case diary.
5. Sri A.Laxma Reddy, SI of Police, has lodged a report before P.S., Karimnagar Rural, on 28.08.2026. It is stated in the complaint that he and his staff went for patrolling, when they reached Karimnagar-Peddapalli railway line situated at the outskirts of Bommakal, they noticed some persons under suspicious circumstances, apprehended them and they found a plastic cover, on search they could able to find hash oil and Tapentadol tablets of 50mg. Complainant has secured the mediators and conducted confession-cum-seizure panchanama, wherein the persons have confessed that they have committed the offence. Basing on the said complaint, FIR came to be registered.
6. Petitioner-accused No.6 was arrested and remanded to judicial custody on 28.08.2026. Remand case diary goes to show that respondent has seized one mobile phone (Remdi 9 Power) found the possession of the petitioner-accused No.6 and he is a consumer of hash oil. Petitioner is a student of B.Tech 4th year, admittedly hash oil is seized from accused No.1-Morri Akash and ganja is seized from accused No.2-P.Vishnu Sai @ Manoj and Tapentadol tablets 50mg is seized from accused No.3-B.Nithin. Petitioner-accused No.6 has made out a case for grant of bail. Hence, petitioner-accused No.6 is entitled to be enlarged on bail, subject to the following conditions: i. The petitioner-accused No.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the I Additional Sessions Judge, Karimnagar. ii.
