ORDER
With the consent of both parties, this Writ Pctitior-r is taken up for disposal at the adnrission stage
2. This writ petition is filcd declaring the action of the respondent No.3 in not receiving, processing, registering and releasing the Sale Deed dated 26.O9.2026 in respect of thc property i.e., Plot No.2 admcasuring 400 Sq.Yds in Sy.No.91 situated at Gachibo'*'li Villagc under GHMC Serilingampall.l, Mandal, Ranga Reddy District as arbitrary and itlegal.
3. Heard Sri V.Yadu Krtshna Sainath, learned counsel for the petitioner and Ms-S Sravanthi, learned Assistant Government Pleader appearing for the respondents and perused the record.
4. During the course of arguments, learned counsel for the petitioners has confined his prayer and submits that respcndent No.3 is refusing to register the document presented by the petitioners in respect of subject property Therefore, the leartledcounselpraysthisCourttoissuesuitabledirectionsto the respondents.
5. Learned Assistant Government Pleader submits that the official respondents will follow' the procedure contemplated under Section 71 of the Registration Act, 1908' 6 . Section 7 1 of the Registratron Acl, 1908 rcads as follows: Reasons for refusal to register to be recorded -
(1) Every Sub-Registrar refusing to register a document, except on the ground that the propertv 1o u'hich it relates is not situated within his sub-district shall make an order of refusal and recorded his reasons for such order in his Book No.2, and cndorse the r,r'ords 'registratlon rcfused" on the document; and, on application made b1' any person executing or claiming under the document. shall. without payment and unnecessan' delal , give him a copv of the reasons so recorded.
(2) No registering officer shall accept for registration a document so endorsed unless and until, under the provisions hereinafter contarned. the document is directed to be registcrcd. T. In vieu' of lhe above submissions couplcd with thc provision under Section 71 of the Registratron Act, 1908, this Writ Petition is disposed of directing the Registering Authority to receive and process the documents sought to be presented by the petitioners in respect of tl-re subject property, subject to the petitioners compl-ving r,r'ith the provisions of the Registration Act, 1908 as well as the Indian Stamp Act, 1899. It will be open to the Registering Authoritl' to refusc the clocuments presented before him, if he has any objection, duly assigning reasons in support of such decision and communicate the said decision lo the petitioners. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioners to get the subject documents registered.
