ORDER:
Heard learned counsel for the petitioner, Mr. V. Siddharth Goud, learned counsel, representing Mr. V. Narasimha Goud, learned standing counsel for the respondents lJo.3 and 4 - HMDA, Mr. K. Ravi Mahender, learned standlng counsel for respondent No.5 - Cyberabad Municipal Corporation (Cl4C) and Mr. Putta Krishna Reddy, learned standing counsel for respondent No.6.
2. Learned standing counsel for HMDA subnritted that Shortfall of Provisional Occupancy Certificate dated 23.12,2025, rmpugned in this writ petition, is issued to the petitioner in view of Lr.No.Dl/2562 /2024 dated 02.t2.2024 issuecl by the District -
Collector to the Commissioner and Inspector General (Registratlon and Stamps), Telangana. stating that LRA.No.1 of 202L is pending before the II Additlonal District Judge, Ranga Reddy - cum - LRAT and recommended inclusion of land admeasuring Ac.133.19 guntas in respect of Sy.Nos.15, 41,83, 133, 135, 136,336,337 and 511. Bachupally Village and Mandal and requested not to entertain any further registrations.
3. Learned standing counsel further submltted that issuance of Occupancy Certificate is linked to release of mortgage executed by the petitioner. For releasing mortgage, the concerned Sub-Registrar ls required to register the Release Deed. Thus, based on letter dated 02.12.2024, the occupancy c"ertificate has been refused.
4. Learned counsel for the petitioner relied on order passed this court ln wP.No.21927 0f 2026 dated 07.08.2026 and submitted that in similar circumstances, the writ petition has been disposed and in para 5 therein it was held as under: "5. in the opinion of this Court, mere pendency of a land ceiling case and status quo order passed against a third party cannot be a ground not to issue occupancy certificate. The issuance of occupancy certificate depends upon construction being made in accordance with the sanctioned plan or not. Building permission was granted to the petitioner on 20,02.2023, which is so far no cancelled. The consideration of occupancy certificate is only to verify if construction is made as per building permission.
tEu
The occupancy certificate cannot be refused for extraneous reasons. If the subject land is covered by land ceiling proceedings, it is for the appropriate authority to take action in accordance with law and the same cannot be a ground to reject the occupancy certificate. "
5. In view of the above, the instant writ petition is squarely covered by wP.No.21927 of 2026 dated 07.0r3.2026.
6. Accordingly, the writ petition is disposed of with a direction to the respondent No.2 to consider the application of the petitioner for issuance of occupancy certificate for buildinll consisting of Stilt + 3 Upper Floors, Plot No.413, Sy.Nos.133 and 135, Bachupally Village and Mandal, Medchal Malkajglri District, without reference to the letter of the District Collector_ dated 02.72.2024, provided if construction made by the petitioner is in accordance with the sanctioned plan. However, this order shall nol come in the way of either GH MC/CMC/H MDA/Revenue authorities t:o take action against the petitioner, if the property of the petitioner is covered by land ceiling proceedings in CC.No.7O2/M11975 dated 18.12.2019 and LRA.No.1 of 2027. The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs. .1 SD/- M.OSMAN ALI BAIG ASSISTANT REGISTRAR //TRUE COPYII SECTION OFFICER
