1. This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioners – A1 and A2 on bail in connection with Crime No.62 2026 of P.S. 2. Heard Sri K.Aravind, learned counsel for petitioners – A1 and A2 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

3. Learned counsel for the petitioners submits that the prosecution case even if accepted at its highest, does not disclose the essential ingredients of abetment of suicide. What the record discloses at best is a failed personal relationship of the deceased with petitioner No.2 - A2. The sequence does not constitute the offence under Section 108 of the BNS. Suicide note is relevant but it is not a conclusive of abetment. The alleged assault at RTC Cross Roads, Hyderabad, even if it occurred is a distinct incident of alleged simple hurt-abuse. It is not proximate to the hanging at Chennaram in the early hours of 07.07.2026. After the incident, deceased travelled, met LW5-M.Ramesh, who consoled him, returned to his Village, slept at his house on 06.07.2026 and only thereafter took the extreme step. Originally the FIR is registered under Section 194 of BNS and thereafter it is altered to Section 108 read with Section 3(5) of BNS after recording the statement of LW5-M.Ramesh on 12.07.2026. Entire investigation is

completed and prayed to enlarge the petitioners - A1 and A2 on bail.

4. Learned Additional Public Prosecutor has filed the written instructions of Sub-Inspector of Police, P.S. Revally, Wanaparthy District wherein it is stated that LWs 1 to 14 are examined and also produced the suicide note.

5. M.Chennamma has lodged a report before P.S Revally on 07.07.2026. It is stated in the complaint that her second son by name Mogili Swamy went to Hyderabad saying that he want to study and prepare for a job. On 06.07.2026 at about 5:00 hours he returned home and slept in the house. Later on the same day at 9:00 hours, he informed the complainant that he is going back to Hyderabad and left the house. On 07.07.2026 at about 5:00 hours, her nephew Mogili Shekar came to her house, woke her up and informed that her son Mogili Swamy hanged himself to a tree near the Gram Panchayat Office in the Village. Mogili Shekar has took one paper from the deceased pocket which was written in the handwriting of the deceased. The written note states that he is in love with Gopala Laxmi for the past six years. Gopala

Laxmi was in love with another person. Another person has beat the deceased. Basing on the said complaint, FIR came to be registered against unknown accused for the offence under Section 194 of BNSS.

6. Petitioners-A1 and A2 are arrested and remanded to judicial custody on 26.08.2026, since then they are in jail.

7. Section of law came to be altered on 12.07.2026 after five days of the incident from Section 194 BNSS to 108 BNS.

8. On perusal of the suicide note of the deceased which states that he is in love with petitioner No.2-A2 for the past six years, but whereas petitioner No.2-A2 was in love with petitioner No.1-A1.

9. Remand Case Diary goes to show that LW14-V.Rajitha has collected PME report of the deceased from LW12- Dr.B.Chinna, Associate Professor, Department of Forensic Medicine, Wanaparthy. Respondent has altogether examined 14 witnesses in support of the case. Major portion of the investigation is completed and detaining the petitioners-A1 and A2 further in judicial custody will not serve the purpose.

Hence, they are entitled to be enlarged on bail subject to following conditions. i. The petitioners – A1 and A2 shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of learned Principal District and Sessions Judge, Wanaparthy. ii. The petitioners –A1 and A2 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Sunday, Tuesday and Thursday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required. iii. The petitioners – A1 and A2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS). iv. The petitioners – A1 and A2 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses. v. liberty to file an application for cancellation of bail.
