Petition under Article 226 of the constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the High Handed action of the respondent No. 2 and 3 not to lnterfere and dispossess the petitioners from their possession without issuing any notice and without following the due procedure of law of the petitioners peaceful possession of the land in Sy.No.964/AA4/1, admeasuring an extent of 907.5 sq yards (Ac.0-0750 gts) of the 1st petitioner, and land in Sy No.964iAA4l2, admeasuring an extent of 847 sq yards (Ac.0-0700 gts ) of the 2nd petitioner, situated Patancharu and Cyberabad Municipality, Hyderabad arbitrary and violation of the principal natural Justice and offends Art.14 and 21 of the Constitution of lndia and consequently direct the respondents Not to lnterfere and dispossess the petitioner peaceful possession of the of the land in Sy No.964/AA4l1, admeasuring an extent of 907.5 sq yards (Ac.0-0750 gts) of the lst petitioner, and land in Sy No.964/AA4/2, admeasuring an extent of 847 sq yards (Ac.0-0700 gts ) of the 2nd petitioner, situated Patancharu and Cyberabad Municipality, Hyderabad without issuing any notice and without following the due procedure of law.

Heard Mr. G. Ravi, leamed counsel for the petitioners and Mr. K. Ravi Mahender, leamed standing counsel for Cyberabad Municipal Corporation (CMC) for respondent Nos'2 and 3'

Leamed standing counsel for CMC submitted that due process of law will be followed if any action is taken against the petitioners in connection with land admeasuring 907'5 square yards (Ac.0-0750 guntas) and 847 square yards (Ac'0-07 guntas) in Survey Nos.964lA{4ll and 964lAA412 respectively situated at Patancheru Village and Mandal, Sanga Reddy District'

On query of this Court as to why respondent Nos'4 to 6 have been made parties to the writ petition, leamed counsel for the petitioners submitted that at their instance, respondent No'3 is interfering with the possession of the petitioners over the subject property.

Recording the aforesaid submission of leamed standing counsel for CMC that due process of law will be followed if any action is initiated against the petitioners, the writ petition is disposed of.

As this order is passed without entering into the merits, notice to respondent Nos.4 to 6 is dispensed with' If respondent Nos.4 to 6 are in any way aggrieved by this order, they are at liberty to approach this Court seeking modification of this order'

No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed'
