Petitioner-Accused is in jail since 12.07.2026 for more than 60 days and he is a senior citizen, retired from Air Force, suffering with health ailments. Entire investigation is completed and prayed to enlarge the petitioner-Accused on bail.

On 09.07.2026 and 10.07.2026, when the complainant daughter went to tuition the accused misbehaved with her daughter when she was alone and he put his hands on her daughter’s chest and private parts. Her daughter informed the complainant. Accused threatened the victim that if she informs to anyone about the incident, he would tell the KV school teachers and give low marks. Basing on the said complaint FIR came to be registered on the same day under Sections 74, 75(1)(i) BNS and Section 9(f)(l) r/w 10 POCSO Act, 2012.

7. Petitioner-Accused is arrested on 12.07.2026 at 15.30 hours and he is remanded to judicial custody on the same day, since then he is in jail.

8. Remand Case Diary goes to show that respondent has examined altogether ten witnesses in support of the case.

9. Leaned Additional Public Prosecutor has produced Section 183 BNSS statement of the victim, wherein she stated with regard to the manner in which the incident has occurred.

10. Since investigation is completed, charge sheet is already filed and SC number is awaited, detaining the petitioner- Accused further in judicial custody will not serve the purpose.
