ORDER:

Mr. L.Ram Singh, learned counsel appears for the petitioner.

Mr. T.Ramesh, learned Assistant Government Pleader for Health, Medical and Family Welfare Department, appears for respondent No.1.

Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences (hereinafter referred to as “the University”), appears for respondent No.2.

2. This Writ Petition is filed for the following relief: “For the reasons stated in the accompanying affidavit, it is prayed that this Hon’ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents particularly the 2nd respondent in not considering the petitioner for counselling and admission into MBBS/BDS course under Management Quota “C” NRI Category for the academic year 2026-27 though petitioner got registration for B and C NRI Category by uploading the NRI documents and petitioner name is not listed in the in-eligible list, as illegal, arbitrary, unconstitutional and consequently direct the respondents to consider and include the name of the petitioner for admission into MBBS/BDS course under Management Quota “C” NRI category for the academic year 2026-27 in next phase of counselling and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

3. Learned counsel for the petitioner submitted that though the petitioner exercised web options for “B” Category, she could not exercise web options for “C” Category as the window for exercising “C” Category did not open. Petitioner submitted NRI documents at the time of registration for admission into MBBS/BDS Course for the academic year 2026-27 and petitioner is also not shown in the list of ineligible candidates. He further submitted that the petitioner preferred a representation before the University on 22.09.2026, but the same has not yet been considered. He further submitted that the University be directed to decide the said representation in a time bound manner.

4. Learned Standing Counsel for the University submitted that the petitioner’s representation shall be dealt with by the University in accordance with law.

5. Accordingly, the instant Writ Petition is disposed of directing the University to decide the petitioner’s representation dated 22.09.2026 as per the grounds taken in it and in accordance with law, by passing a reasoned order before the next counselling. It is made clear that this Court has not expressed any opinion on the merits of the case. There shall be no order as to costs.
