ORDER
1. This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.2 and 3 in connection with FIR.No.800 of 2026 of Keesara Police Station, Malkajgiri District, registered for the offences punishable under Sections 69, 316(2) and 318(4) of the BNS, 2023.
2. Heard Sri A.Kranthi Kumar Reddy, learned counsel for the petitioners-accused Nos.2 and 3, Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State and Sri N.Kumaraswamy, Advocate for the complainant.
3. Learned counsel for the petitioners submits that Section 69 of the BNS is not attracted to the petitioners-accused Nos.2 and 3, Sections 316(2) and 318(4) of the BNS are not applicable to them. Petitioners-accused Nos.2 and 3 are arrested and remanded to the judicial custody on 21.08.2026, since then they are in jail. The allegations made in the complaint are false. Complainant has earlier lodged a complaint before P.S., Jagadgirigutta on 27.05.2026, basing on which FIR.No.740 of 2026 came to be registered against accused No.1-Narla Naga Vishnu Vineeth. Entire investigation is completed and prayed to enlarge the petitioners- accused nos.2 and 3 on bail.
4. Learned Additional Public Prosecutor submits that the role played by the petitioners-accused Nos.2 and 3 is clearly depicted in the remand case diary.
5. Notice got issued to the de facto complainant is served and proof is filed to that effect.
6. Sri N.Kumaraswamy, learned counsel for the de facto complainant submits that specific overt acts are attributed against the petitioners-accused nos.2 and 3 with that of accused No.1 and another crime is also registered in Crime No.920 of 2026 against the petitioners-accused Nos.2 and 3 and against their son, which is under investigation and prayed to dismiss the petition.
7. De facto complainant has lodged a report before P.S., Jagadgirigutta on 27.05.2026 against Narla Naga Vishnu Vineeth, stating that he has demanded dowry amount of Rs.15,00,000/- and tied Mangalsutra around her neck near Ammapalli Temple and informed her that they were married. Subsequently, she gave Rs.2,00,000/- apart from the above said amount and she was cheated. Basing on the said complaint, FIR.No.740 of 2026 came to be registered for the offences punishable under Sections 318(2), 318(4), 351(2) and 352 of the BNS.
8. While things stood, the de facto complainant has lodged another complaint before P.S., Keesara, on 08.08.2026, stating that believing that she was married to the accused No.1 and participated in sexual intercourse on several occasions. Later accused No.1’s father and mother refused to accept their relationship and marriage stating that their families belongs to different castes and that she was not suitable for their family. Accused has obtained Rs.2,00,000/- from her as dowry and continued his physical relation with her, threatened and blackmailed her by insisting that the matter should not be disclosed and he refused to marry her. Basing on the said complaint, FIR.No.800 of 2026 came to be registered for the offences punishable under Sections 69, 316(2) and 318(4) of the BNS, 2023.
9. Petitioners-accused Nos.2 and 3 along with accused No.1- Narla Naga Vishnu Vineeth, were arrested and remanded to judicial custody on 22.08.2026, since then they are in jail. Remand case diary goes to show that respondent has examined altogether 10 witnesses. It is appropriate to note here that in the last paragraph of the remand report which states that petitioners-accused Nos.2 and 3 are punishable for the offences under Sections 316(2) and 318(4) of the BNS, which are punishable for 5 years and 7 years respectively.
10. Petitioners-accused Nos.2 and 3 have filed Crl.M.P.No.586 of 2026 before the learned Sessions Court, which came to be dismissed vide order dated 10.09.2026. The observation of the learned Sessions Court is that Section 69 of the BNS is also applicable to the petitioners-accused Nos.2 and 3, which is incorrect.
11. Petitioners counsel submits that Crime No.920 of 2026 is registered against petitioners-accused Nos.2 and 3 when they were in judicial custody.
12. Remand case diary goes to show that major portion of the investigation is completed and detaining the petitioners-accused Nos.2 and 3 further in judicial custody will not serve the purpose. Hence, petitioners-accused Nos.2 and 3 are entitled to be enlarged on bail, subject to the following conditions: i. The petitioners-accused Nos.2 and 3 shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the II Additional District and Sessions Judge-cum-I Additional Metropolitan Sessions Judge- cum-II Special Sessions Judge for Fast Tracking the Cases Relating to the Atrocities Against Women-cum-Family Court, Medchal-Malkajgiri District. ii. v. It is made clear that if any of the above conditions are violated, the prosecution is at liberty to file an application for cancellation of the bail.
13. Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed. __________________________ B.R.MADHUSUDHAN RAO, J
