2. Heard Mr.Kondaparthy Kiran Kumar, le,arned counsel for the petitioner and learned Assistant Gover -rment preader for Higher Education appearing for respondent N'os. 1, 3 and 5. Perused the record.
3. The brief facts of the case are that the petitioner is a meritorious student and completed his Intermediate Education, at respondent No.g-College, during the academic years 2024-2O25 and 2025-2026. The petitioner appeared for TG LAWCET-2O26 examination with Hall ticket No.22632310903 and secured State Rank 772 under the SC Categor)'. Pursuant thereto, the phase-I u,,:b counseling conducted by respondent No.6 and the Jretitioner was provisionally' allotted a seat in 5 year LL.B. courre at Mahatma Gandhi Lau,' College, L.B. Nagar under the SC quota. It is stated that during August, 2026 the petition,rr approached respondent No.8 for rssuance of his Transfer Ce -tificate, Study Certificate and other allied records for comple ting his LL.B. admissior-r. But the Management of responden: No.B refused J and demanded a sum of Rs.50,000/- as condition precedent for releasing the said certificates. Aggrieved by the same, the petitioner filed the present Writ Petition. 4 . Learned counsel for the petition er submits that the Honlcle Supreme Court, in catena of judgments, held that the Educational records, Transfer Certificates and Marks memos are the personal property of the student and cannot be retained as a pledge, security or lien lor alleged unpaid lee dues. If at all the institution has any legitimate financial claim, its remedy lies before the competent civil Court and not by withholding the certificates.
5. He further submits that, as per the admission schedule notified by respondent No.6, the candidates must physically report at the allotted colleges betu'een 3I .O8.2026 and O5.O9.2026 and for the phase-lll counseling, the last date for giving the provisional list of candidates is on 25.09 '2026 before which the original certificates of the petitioner are to be verified.
6. He further states that respondent No.7 is strictly insisting on the production of the original transfer certificate issued by respondent No.8 and cautioned that the provisional admission of the petitioner stands cancelled if the transfer - .l certificate is not produced at the time of reporting. Therefore, he seeks the indulgence of this Court to pass appropriate orders.
7. In view of the submissions of learned cc,unsel for the petitioner, on perusal of the record, this court is of the opinion that the Educational certificates of the studert are his/her property and a College caxnot retain the said ce;.tificates, even if it has a monetarl. c1aim. Since, the last date for giving the provisional list of candidates for phase-lll cour seling expires by tomorrow i.e., 25.O9.2026, this Court deems it appropriate to direct respondent No.8 to release the Transler Certificate, Study Certificate and other allied records perrarning to the petitioner forthr,r'ith, rvithout any delay.
8. With the above direction, this Writ petition is disposed of. No costs. Miscellaneous petitions pending, if any. shali stand c lo sed. //TRUE COPYII Sd/.K.BHAVANI SWAMY ASSISTANT REGISTRAR
