ORDER
This Criminal Petition is filed aggrieved by the order dated 24.08.2026 passed by the leamed II Additional Judicial Magistrate of First Class, Khammam, in Crl.M.P.No.1340 of 2026 in C.C.No.t294 of 2024, wherein the application filed by the petitioner seeking to recall the Non-Bailable Warrant (NBW) issued against him was dismissed
2. Heard Mr.Mayur Mundra, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, leamed Additional public prosecutor for respondent No.1.
)
3. Notice in respect of respondent No.2 is dispensed with solely on the ground that the petitioner is not seeking any reiief against respondent No.2 and is only seeking recall of the NBW issued by the leamed triai Court.
4. Learned counsel for the petitioner submits that the petitioner is accused No.l in C.C.No.1294 of 2024 and is facing prosecution for the offences punishable under Sections 499 and 500 r/w. 34 of the Indian Penal Code, I860 (for short, 'IPC'). He further submits that the matter before the leamed trial Court was posted for examination of the petitioner on 04.06.2025. Due to unavoidable circumstances, the petitioner could not appear on 04.06.2025. However, he filed an application under Section 317 of the Cr.P.C. through his counsel, seeking dispense with his personal appearance. The leamed trial Court, without considering the aforesaid circumstances, issued an NBW by invoking the provision under Section 10(2) of the BNSS. The leamed trial Court erroneously dismissed the said application. He further submits that the petitioner is the Managing Director and Managing Editor of AGA Publication Ltd. and is a senior citizen, and that he will appear before the trial Court. Unless the aforesaid NBW
issued against the petitioner is recalled, the petitioner will be put to great hardship.
5. Per contra, the leamed Additional Public Prosecutor submits that C.C.No.1294 of 2024 was posted for examination of the accused on t14.06.2025 and the presence of the petitioner was very much required. The petitioner intentionally did not appear befbre the leamed trial Court. The NBW was issued against the petitioner on 04.06.2025. The petitioner had knowledge of the issuance of the NBW. He filed an application seeking recall of the NBW on 06.08.2026, after a period of more than one year, without propuly assigning any reasons. The leamed trial Court rightly dismissed the said application.
6. Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the petitioner was arrayed as accused No.l in C.C.No.1294 of 2024. Even according to the learned counsel for the petitioner, the matter before the leamed trial Coun was posted for examination of the accused, and the presence of the petitioner was required. The specific case of the petitioner is that, on 04.06.2025, due to unavoidable circumstances, he could not appear before the leamed trial Court.
It However, he filed an application seeking dispense with his personal appearance, but the leamed trial Court, without granting an opportunity, much less a reasonable opportunity, issued an NBW against the petitioner on the very same day.
7. Taking into consideration the peculiar facts and circumstances of the case and the age of the petitioner, this court is inclined to recall the NBW issued against the petitioner. Hence, the impugned order dated 24.08.2026 passed by the ieanred trial court is liable to be set aside and, accordingly, the sarne is hereby set aside'
8. In view of the same, this Codrt is inclined to recall the NBW issued against the petitioner on 04.06.2025, subject to the following conditions: i) The petitioner shall execute a personal bond for a sum of Rs. 1,00,000/- (Rupees one lakh only) with two sureties to the satisfaction of the ieamed trial Courl' ii) The petitioner shall file undertaking affidavit before the trial Court that he will appear before the trial Court whenever his presence is required, and also he shall represent the matter through his counsel each and every r-17 To, date of adjoumment, in default, the leamed trial Court is entitled to proceed with the matter, in accordance with law
9. Accordingly. the Criminal Petition is disposed of'. Miscellaneous applications, pending if any, shall stand closed. SD/- M.
