final order dated 19112/2023 jn Contempt Case No. 2695 of 2023.
Counsel for the petitioners : Mr. y Rama Rao and Associates Counsel for the Respondents : Ms. Ramani Vemuganti The Court made the fo owing:
r'A-No 1 0f 2024 has been fired for restoration of contempt case No.26g5 0f
2023.
This Bench on 19.12.2023 had disposed of the contempt case then on a specific undertaking given by the respondents and their counsel thal they shall ensure maintaining status quo as it existed on 19.12.2023. rt was arso made crear that in the event if the said order was not honoured, the petitioners wourd be at liberty at get the contempt case revived. The interim order of stalus quo that was granted by this court was on 15 11.2023 in r.A.No.2 0f 2023 in w.p.No.26223 0f 2023 The said writ petition was fired by the respondents/contem nors questioning the Lok Adarat set'emenuaward that was arrived at. The said wrt pet*ion finary went against the respondents/contemnors vide judgment dated 27.01 .2025. rn spite of the respondents/contemnors rosing in the writ petition paying no heed to the undertaking given to the court and atso in utter vioration of the order of status quo granted in the writ petition, the respondents/contemnors have proceeded with the conskuction over the subject premises and have now went on to comprete the entire construction activity itserf rhis aspect is not disputed by the rearned counser appearing for the respondenls/ contemnors. The only explanation he tries to give is that whatever construcrion that has taken prace is after the dismissar of the writ petition that the respondents have fired and since the writ petition was not pending, it wourd not fa, within the purview of contempt of courts Act. The aforesaid contention of the petitioners prima facie refrects of an acceptance of having carried on with the construction subsequent to the interim order granted by this court and even after the respondents having rost in the writ petition that they had fired. Hence, we are of the considered opinion that a strong case for revivar of the contempt case has been made out.
Accordingly, l.A.No.1 of 2024 stands allowed restored to its original number.
