ORDER

1. This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner on bail who is arrayed as accused in connection with Crime No.238 of 2026 of P.S. Narayanpet Town, Narayanpet. The offence alleged against the petitioner-accused is punishable under Section 318(4) of the Bharatiya Nyaya Sanhita Act, 2023 (for short ‘BNS’).

2. Heard Sri B.Karthik Navayan, learned counsel for petitioner-accused and Sri D.Arun Kumar, learned Additional Public Prosecutor for respondent - State.

3. Learned counsel for the petitioner submits that allegations in the complaint dated 28.07.2026 disclose that the de facto complainant claims to have advanced funds intermittently over an extended period (from July, 2025 to June, 2026) towards processing fees, commissions and loan assistance, such allegations taken at their highest which constitute a civil/commercial transaction which does not attract Section 318(4) of BNS. Petitioner-accused is ready and willing to abide by any conditions that the Court may deem fit and proper to impose. Police has not taken the custody of the petitioner-accused as on date, entire investigation is completed and prayed to enlarge the petitioner-accused on bail.

4. Learned Additional Public Prosecutor submits that petitioner-accused is involved in another case, in which 41-A notice is given in the first crime. The role played by the petitioner-accused is depicted in the remand case diary and prayed to dismiss the petition.

5. The de facto complainant has lodged a complaint on 28.07.2026 stating that she and the accused developed friendship through face book in the year 2014, later the accused told her that he will sanction Housing loan through SBI and he took an amount of Rs.45,000/- from her in installments, altogether he has taken an amount of Rs.4,75,000/-. Basing on the said complaint, FIR came to be registered.

6. Petitioner-accused has filed Crl.P.No.13121 of 2026 before this Court for grant of regular bail, the same came to be dismissed vide order dated 21.08.2026. It is observed in the order that petitioner-accused is required for police custody.

7. Petitioner-accused was remanded to judicial custody on 08.08.2026, since then he is in jail, as on date Police has not taken the petitioner-accused for police custody and the learned Additional Public Prosecutor has also submitted the same. The remand case diary goes to show that respondent- State has altogether examined 7 witnesses in support of the case. It appears from the record that major portion of the investigation is completed, detaining the petitioner-accused further in judicial custody will not serve the purpose, hence the petitioner-accused is entitled for grant of bail.

8. In the result, petition is allowed subject to the following conditions: i. The petitioner-accused shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for a like sum each to the satisfaction of the learned Additional Judicial First Class Magistrate at Narayanpet.

ii. The petitioner-accused shall appear before the concerned SHO in between 10:00 a.m. and 5:00 p.m., on every Sunday, Tuesday and Thursday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner-accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner-accused shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Miscellaneous applications, if any pending, shall stand closed.
