ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.1 to 3 in Crime No.368 of 2026 on the file of Mavala Police Station, registered for the offence punishable under Section 310(2) of BNS.

2. The brief facts of the case are that on 04.06.2026 at about 11:00 hours, the complainant lodged a report stating that he was acquainted with one girl and on the previous day, while both of them were conversing near NH-44, certain persons approached them, questioned their relationship, misbehaved with the girl, and thereafter demanded money from the complainant. It is alleged that they forcibly took his mobile phone, made him transfer an amount of Rs.2,500/- to one of the accused, assaulted him and threatened him with dire consequences. Based on the said complaint, the present crime came to be registered against the petitioners and others.

3. Heard Sri Soma Ravi Kiran Reddy, learned counsel for petitioners, and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing on behalf of the respondent – State.

4. Learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in the present case. It is contended that no specific overt acts are attributed to the petitioners and the allegations are vague and baseless. It is further submitted that no amount was actually transferred to the account of the petitioners and Section 310(2) of BNS is wrongly invoked. He also submits that the investigation is almost completed, material witnesses have already been examined, and only filing of charge sheet remains. The petitioners are in judicial custody since 04.06.2026 and are ready to abide by any conditions imposed by this Court. Hence, prayed this Court to grant bail.

5. Learned Additional Public Prosecutor opposed the submissions and contended that the allegations against the petitioners are serious in nature, involving wrongful restraint, extortion and criminal intimidation. It is submitted that the petitioners, along with other accused, have acted in a group and committed the offence by threatening the complainant and forcibly obtaining money from him. Considering the gravity of the offence and the manner in which it was committed, if the petitioners are enlarged on bail, there is every likelihood of their influencing the witnesses. Therefore, prayed to dismiss the petition.

6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioners are in jail since 04.06.2026. Record clearly shows that material part of investigation is completed, and LWs.1 to 9 are already examined. Considering the incarceration period of the petitioners, and the progress in investigation, this Court deems it fit to grant bail to the petitioners, subject to the following conditions: i. The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Adilabad. ii. The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J
