This Criminal Petition is filed under Section 480 and 483 of BNSS seeking the Court to enlarge the petitioner on bail, who is arrayed as accused in Crime No.159 of 2026 of Nalgonda I Town Police Station, Nalgonda District, registered for the offences punishable under Sections 196, 132, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 (BNS).
2. The brief facts of the case are that on 20.06.2026, the de-facto complainant, who is the Superintendent, District
Prison, Nalgonda sent a letter vide Lr.No.DPN/RC/1870-73/76 stating that the petitioner, who was lodged in prison in connection with Crime No.232 of 2026, left his allotted barrack without permission on 18.06.2026, breached jail security and quarrelled with the on-duty warder at the main gate. While the jail staff were conducting their routine rounds, the prisoner created unrest among the inmates by provoking regional and caste-based sentiments, threatened the jail authorities and disturbed the peaceful atmosphere of the prison. Following a departmental enquiry, disciplinary punishment was imposed under Rule 315(8), (9) and (12) of the TGPR by without holding interview, canteen and telephone facilities for one week. The petitioner refused to take food unless the prison diet menu was changed and continued to create nuisance and disrupt prison administration. Consequently, a complaint was lodged for necessary action. Based on the said complaint, the police registered a case for the aforesaid offences.
3. Heard Sri Mukesh Samala, learned counsel for the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent - State.
4. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case and has been in judicial custody in another case since 17.06.2026 and was granted bail therein by this Court vide order dated 17.07.2026 in Criminal Petition No.11076 of 2026. He further submitted that the petitioner has already undergone departmental punishment for the alleged misconduct. Therefore, his further detention is unwarranted and prayed the Court to grant bail to the petitioner by allowing this criminal petition.
5. On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the petitioner is a habitual offender and that several criminal cases are registered against him. He further contended that if the petitioner is released on bail, there is every chance of the petitioner repeating similar offences. Therefore, he prayed the Court to dismiss the Criminal Petition.
6. Having considered the submissions made by the learned counsel for the petitioner and the learned Additional Public Prosecutor and upon perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 17.06.2026 in connection with Crime No.232 of 2026. The allegations in the present case pertain to an incident that allegedly occurred on 18.06.2026 while the petitioner was in judicial custody, pursuant to which a report was lodged with the police. Considering the overall facts and circumstances of the case, the stage of investigation, the period of incarceration undergone by the petitioner and the fact that he has already been granted bail in the original crime in connection with which he was remanded to judicial custody, this Court is inclined to enlarge the petitioner/Accused on bail, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Nalgonda.
ii. The petitioner shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
7. Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 24.07.2026 SS
