This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.644 of 2026 of Dundigal Police Station, Cyberabad District. The offences alleged against the petitioner are under Sections 329(3) and 125 of the Bharatiya Nyaya Sanhita, 2023 and under Section 25(1-B) (a) of the Arms Act, 1959.

2. The facts of the case are that on 27.06.2026 at about 2:15 a.m., while on patrol duty, the Sub-Inspector of Police, Dundigal Police Station, received a Dial-100 call reporting that unidentified persons had entered a house. On reaching the spot, the police learnt that the house owner and his family noticed an unknown person inside the premises, who fled by jumping over the gate after they raised an alarm. During his escape, a pistol allegedly fell from his possession, which was noticed by the family members and reported to the police. Basing on the same, a case was registered for the above offences.

3. Heard Sri M. Keshav Yadav, learned counsel appearing for the petitioner and Sri D.Arun Kumar, learned counsel appearing for the respondent.

4. The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and no offence is committed by the petitioner. In fact petitioner herein was not present at the scene of offence and that he had no criminal antecedents. She further contended that petitioner is in jail from 29.06.2026 and material part of investigation is already completed. As such, requested this Court to grant bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed bail contending that the alleged offences against the petitioner are serious in nature. Petitioner attempted to commit theft and he also used pistol and that investigation has to be done on that aspect also. Therefore, at this stage, petitioner is not entitled to bail and prayed to dismiss this petition.

6. Considering the submissions made and the material on record, the petitioner herein is in jail from 29.06.2026 and as seen from the record, Lws.1 to 13 are examined. Considering the nature of allegations, period of incarceration of petitioner in jail and the progress in investigation, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the VIII-Additional Judicial First Class Magistrate at Medchal.

ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

7. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date : 23.07.2026 Rds
