ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.18/RCA-CR-2/2026 on the file of Anti Corruption Bureau, City Range – 2, Hyderabad, registered for the offence punishable under Sections 13(1)(b) r/w 13(2) of PC Act.
2. The brief facts of the case are that on credible information, the Anti-Corruption Bureau registered a case against the petitioner, who was working as Additional Superintendent of Police, alleging that during his tenure as a public servant, he acquired assets disproportionate to his known sources of income by indulging in corrupt practices. It is alleged that during the check period of his service, the petitioner accumulated movable and immovable properties in his name and in the names of his family members to the tune of about Rs.5.92 crores, whereas his likely savings were only about Rs.88 lakhs, thereby resulting in disproportionate assets to the extent of approximately Rs.5.04 crores. Pursuant to search warrants issued by the competent Court, searches were conducted at various premises connected to the petitioner and incriminating documents relating to assets were seized. Thereafter, the petitioner was arrested on 03.06.2026 and produced before the learned Principal Special Judge for Trial of SPE & ACB Cases, Hyderabad, who remanded him to judicial custody on 04.06.2026.
3. Heard Sri E. Uma Maheshwar Rao, learned counsel for petitioner, and Sri T. Bala Mohan Reddy, learned standing counsel appearing on behalf of the respondent – State.
4. Learned counsel for the petitioner submitted that petitioner is innocent of the offences as alleged and has been falsely implicated in the present case. He further submits that the allegations are baseless and politically motivated. It is also contended that the petitioner is a public servant who has cooperated with the investigation and that no further custodial interrogation is required. He submits that substantial part of investigation is already completed and continued detention of the petitioner is not necessary. He further submits that the petitioner has deep roots in society and there is no likelihood of his absconding or tampering with evidence. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.
5. Learned standing counsel opposes the submissions of learned counsel for petitioner, contending that the petitioner is involved in a serious economic offence involving acquisition of huge disproportionate assets through corrupt practices. It is further contended that during searches, several incriminating documents were seized establishing the possession of disproportionate assets. He submits that the investigation is still in progress and if the petitioner is released on bail, there is every likelihood of tampering with evidence and influencing witnesses. As such, he prayed the Court to dismiss the criminal petition.
6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 04.06.2026. Record clearly shows that material part of investigation is completed, that apart, even according to respondent, no custody petition is filed seeking custody of petitioner. The only apprehension of respondent is that if petitioner is released on bail, he may tamper with evidence. However, considering the fact that the pending investigation in the case can be continued through documentary evidence, and considering the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Principal Special Judge for Trial of SPE & ACB Cases, Hyderabad. ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).
7. Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J
