: ORDER :

This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.8 and 9 in Crime No.680 of 2026 of Jawahar Nagar Police Station, Medchal Malkajgiri District. The offences alleged against the petitioners are under Sections 310(2), 123, 61(2), 127(2) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’).

2. The facts of the case in brief are that the de facto complainant, Sri Murali Mohan Narsipuram, lodged a complaint alleging that on 11.05.2026 at about 8:00 p.m., his maid servants, Rajesh and Sabina, along with seven others, trespassed into his house, threatened him and his wife with crowbars, and administered an unknown poisonous or sedative substance, rendering them unconscious, tied their hands and legs, broke open the almirahs, and committed theft of gold ornaments weighing about 60 tulas, silver articles weighing about 15 kilograms, two mobile phones, cash of 3,000 US dollars, and other valuables. After regaining consciousness, the complainant found the stolen articles missing and the house ransacked. He managed to free himself and raised an alarm, whereupon a passerby rescued them and informed his brother- in-law, who called the police by dialing 100. The complainant further alleged that Rajesh and Sabina had joined as maid servants about 15 days prior to the incident with an intention of committing the offence. Hence, requested the police for taking necessary action against the accused.

3. Heard Sri Muppu Ravinder Reddy, learned counsel appearing for the petitioners and Sri D.Arun Kumar, learned counsel appearing for the respondent-State.

4. The contention of the learned counsel for the petitioners is that the petitioners/A.8 and A.9 have been falsely implicated in this case and that there are material contradictions between the contents of the complaint, the FIR, and the remand case diary. He submitted that the offences alleged against the petitioners are not attracted to them, as they were attending to their respective work at the relevant time and no specific overt acts have been attributed to them. The learned counsel further contends that the prosecution case against the petitioners is based only on presumptions and assumptions, without any material establishing their involvement in the alleged offence. It is also submitted that the petitioners are innocent, have no connection with the alleged crime, and have been unnecessarily implicated by the police. The petitioners are stated to be private workers from Nepal, the sole breadwinners of their respective families, and law-abiding persons and that they have been in judicial custody since 16.05.2026 and charge sheet is not yet filed. Hence, prayed this Court to grant bail to the petitioners by allowing this criminal petition.

5. On the other hand, the learned Additional Public Prosecutor opposed the bail application contending that the petitioners along with other accused actively involved in the alleged offence, the stolen property is yet to be recovered and that investigation is still pending. If the petitioners are released on bail, they may abscond from this Country as they belong to Nepal. Hence, prayed to dismiss this petition.

6. Considering the submissions made and perusal of the material available on record, admittedly, the petitioners herein are in jail from 17.05.2026 and till today charge sheet is not filed. Further as informed to the Court, no other cases are pending against the petitioners. Considering the period of incarceration of petitioners in jail and facts and circumstances, this Court deems it fit to grant bail to the petitioners subject to the following conditions: i. The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the II-Additional District and Sessions Judge, Medchal-Malkajgiri District.

ii. The petitioners shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioners shall abide by the conditions stipulated in Section 483(2) of the BNSS.

7. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date : 21.07.2026 Rds
