2. The case of the prosecution is that the de-facto complainant lodged a report before the Police on 27.05.2026, wherein she stated that the petitioner herein used to harass her. On 22.05.2026, while the de-facto complainant was at her house, the petitioner called her and informed her that his son wanted to eat ice cream and requested her to purchase the same and bring it to his house. Accordingly, after purchasing the ice cream, she went to his house. He asked her to enter the house and misbehaved with her and thereafter, she escaped from the petitioner. On 26.05.2026 de-facto complainant, informed her family members and thereafter, they went to the police station to lodge the report. Basing on the same, Police registered the case against the petitioner.

3. Heard Sri Rama Rao Immaneni, learned counsel for the petitioner/Accused and Sri E. Ganesh, learned Assistant Public Prosecutor, appearing for the respondent- State.

4. The contention of the learned counsel for the petitioner is that the petitioner has been in jail since 22.05.2026; that no such offence has been committed by the petitioner and that the material part of the

investigation has already been completed. Therefore, the further incarceration of the petitioner is not necessary, and he requested the Court to grant regular bail to the petitioner.

5. On the other hand, the learned Assistant Public Prosecutor opposed the same and submitted that the offences alleged against the petitioner are heinous and grievous in nature; that the investigation is not yet completed; that if the petitioner is released on bail, there is every chance of his threatening the victim. However, he informed that the statement of the victim under Section 191 has already been recorded and prays to dismiss the petition.

6. Considering the submissions made by the learned counsel for the petitioner and the learned Assistant Public Prosecutor, the petitioner has been in judicial custody since 28.05.2026, and the record shows that LWs.1 to 14 have been examined and the statement of the victim under Section 191 has already been recorded by the concerned Magistrate. Considering the period of incarceration and the progress in the investigation, this

Court deems it fit to grant bail to the petitioner/Accused, subject to the following conditions:

(i) The petitioner-accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Special Judge for Trail of Cases Under Protection of Children From Sexual Offences (POCSO-Cum-XII Additional Sessions Judge, Hyderabad)

(ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) After release, the petitioner shall not contact the victim and threaten any of the witnesses.

(iv) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed.
