This Criminal Petition is filed under Sections 480 and 483 of BNSS seeking the Court to enlarge the petitioners on bail, who are arrayed as accused Nos.2 and 3 in Crime No.107 of 2026 of Dahegoan Police Station, Kumrambheem Asifabad District, registered for the offence punishable under Section 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

2. The brief facts of the case are that on 10.06.2026, the de- facto complainant, who is father of the deceased, lodged a report before the Police stating that her elder daughter, aged about 17 years had recently completed her Intermediate Second Year and was staying at home. During visits to a relative's house, she became acquainted with Accused No.3, with whom she exchanged phone numbers and communicated through messages. This came to the notice of Accused No.1, who along with Accused No.2, allegedly assaulted the deceased on 04.06.2026 and warned her not to communicate with Accused No.3. Thereafter, the deceased remained silent and informed the complainant that she feared further assault by the accused. On 07.06.2026, while the complainant was away, Accused Nos.1 to 3 allegedly came to the complainant's house, assaulted the deceased, abused her in filthy language, humiliated, insulted and threatened her, including telling her to die if she continued communicating with Accused No.3. Unable to bear the alleged humiliation, threats and mental harassment caused by the accused, the deceased consumed an unknown poisonous substance and was succumbed to effects of poisoning on 09.06.2026 while undergoing treatment. As such, he requested the police to take necessary action. Based on the said complaint, the police registered a case for the abovementioned offences.

3. Heard Sri S. Syam Sunder Rao, learned counsel for the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent - State.

4. Learned counsel for the petitioners submitted that the petitioners have not committed any act amounting to abetment of the deceased to attract the offence alleged against them. He further submitted that Accused No.1, who is the wife of Accused No.3, has already been granted bail. Accused No.2 is the mother of Accused No.1 and Accused No.3 is the husband of Accused No.1. He further submitted that the petitioners have been in judicial custody since 20.06.2026 and that a substantial part of the investigation has already been completed. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

5. On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that the allegations levelled against the petitioners along with accused No.1 are serious and grave in nature and that the investigation is still in progress and that, if petitioners are released on bail, they may hamper the investigation. Therefore, he contended that the petitioners are not entitled to bail at this stage and prayed the Court to dismiss the Criminal Petition.

6. Having considered the submissions made by the learned counsel for the petitioners and the learned Additional Public Prosecutor and upon perusal of the material available on record, it is evident that the petitioners have been in judicial custody since 20.06.2026. As per the remand case diary, the prosecution witnesses, namely LWs.1 to 21, have already been examined. Considering the overall facts and circumstances of the case, the stage of investigation and the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners-Accused Nos.2 and 3, subject to the following conditions: i. The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate at Sirpur-T, Asifabad District.

ii. The petitioners shall appear before the concerned SHO at 11:00 a.m., on every

Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

7. Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 21.07.2026 SS
