3. Case of the petitioner is that, at the time of admission into the B.Tech. CSE (Date Science) course in responden: No.4-college, he submitted all his original certificates, including the 10'h class/SSC lVlemo, Bonafide, Bonafides of 6th to 9th class,-,s, lnter/Diploma lVlemo, Bonafide. Provisional and Transfer C)ertificates. After completion of the course, he submitted a representation, dated 15.06 2026, to respondent No 4 college seekrrg return of his original certificates. Despite such request, respondent No.4 has refused to return the original certificates referred to above to the petitioner and is illegally withholding them on the ground that the tuition fee for the 2nd, 3'd and 4th years of the pr:titioner's B.Tech course remains unpaid, because the fee reimbursenent amount has not been sanctioned by the Government and furtht:r demanded him to pay Rs.3,09,0001, as a condition for releas,,. of his original certificates. Hence, the present writ petition.

4. Learned counsel for the petitioner submits that the petitioner requires his original certificates referred to above, along wtth B.Tech Marks Memo, Transfer and Provisional Certificates, to pursue his lVl.Tech course. He further submits that the action of respondent No.4 in withholding the original certificates submitted by the petitioner at the time of admissjon is illegal and arbrtrary Therefore, he seeks a direction to respondent No.4 to forthwith return the petitioner's original certificates.

5. Perused the record

6. lt is not in dispute that the petitioner had submitted his original certificates referred to above to respondent No.4 at the time of admrssion into B Tech. course and he subsequently completed the course lt is also not in dispute that the original certificates referred to above were presently in the custody of respondent No.4. The said certificates, being personal and academic credentials, are undoubtedly the exclusive property of the petitioner. ln the absence of any statutory or legal authority, respondent No.4 has no authority whatsoever to retain the petitioner's original certificates. Even assuming that the college has any monetary claim against the petitioner, the proper remedy, if any, available is to pursue appropriate proceedings in accordance with law for recovery of its dues. However, the college cannot retain the petitioner,s original certificates as security for recovery of any amount claimed by it and such retention is wholly unlawful and cannot br-. justified on the ground of any outstanding liability. Therefore, this Court is of the considered oprnion that the petitioner is entifled to the immediate return of his original certrficates.

For the foregoing discussion, this Writ petition is allowed, directing respondent No 4 to forthwith return the original certificates i.e 10th class/SSC I\,4emo. Bonafide. Bonafides of 61h to 9rh classes, lnter/Diploma I\4emo, Bonafide and provisional Certificates and B Tech Marks Memo, Transfer and provisional Cr_.rtificates, to the petitioner, within a period of one (1) week, from the date of receipt of a copy of this order.
