: ORDER :
This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in connection with Crime No.316 of 2026 of Armoor Police Station, Nizamabad District. The offences alleged against the petitioner are under Sections 329(4), 326 (g), 109(1), 351(3), 49 r/w. Section 3(5) of Bharatiya Nyaya Sanhita, 2023.
2. The facts of the case are that the de facto complainant, lodged a complaint before police stating that he had lent
Rs.5,00,000/- to A.1 about five years prior to the incident. Although A.1 partially repaid the amount and issued cheques towards interest, a dispute arose when the complainant withdrew Rs.1,75,000/- from A.1's bank account using a cheque. On 05.06.2026, A.1 allegedly came to the complainant's house carrying a can of petrol, criminally trespassed into the house, questioned the complainant for withdrawing the money without informing him, threatened to kill the complainant and his family, poured petrol inside the house and set it on fire. As a result, the complainant and his wife sustained burn injuries, household articles worth about Rs.30,000/- were damaged, and they were rescued by neighbours and shifted to the Government Hospital, Armoor. It is further alleged that A.2 also came to the scene and threatened the complainant and his family with dire consequences before both the accused fled from the spot. Based on the complaint, the present crime is registered.
3. Heard Sri Hussain Aamir, learned counsel appearing for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.
4. The contention of the learned counsel for the petitioner is that petitioner was falsely implicated in the present case due to a monetary dispute between the parties and that the allegations in the complaint are false, exaggerated and motivated. It is further submitted that the petitioner has been in judicial custody since 06.06.2026, his custodial interrogation has already been completed, the investigation has substantially progressed, the material objects have been seized, and several witnesses have been examined. He further contended that no further recovery is required from the petitioner and his continued detention serves no useful purpose. Learned counsel further submits that there is no prima facie material connecting the petitioner with the alleged offences and that the ingredients of the offences invoked against him are not made out at this stage. According to the learned counsel, the prosecution allegations require appreciation of oral and documentary evidence during trial, and the correctness of the prosecution case can only be tested through cross-examination. He also contended that the petitioner has no criminal antecedents and there is no likelihood of his interfering with the investigation or fleeing from justice. Hence, prayed this Court to grant bail to the petitioner by allowing this criminal petition.
5. Considering the submissions made by both the counsel and the material on record, the petitioner herein is in jail from
06.06.2026. The record shows that Lws.1 to 14 are examined. Though the learned Additional Public Prosecutor opposed the same stating that the allegations are serious, considering the period of incarceration and progress in investigation, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class at Armoor.
ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.
7. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date : 20.07.2026 Rds
